Some good news for Texas taxpayers came down from a federal judge on Monday. A federal judge issued an emergency Temporary Restraining Order against the Biden administration from “disassembling, degrading, tampering with” concertina wire barriers.

The TRO means that the Department of Homeland Security (DHS) and Border Patrol agents (CBP) can not tear down or cut through razor wire in order to allow illegal immigrants access into crossing the U.S.-Mexico border. Once illegal immigrants come out of the Rio Grande River and attempt to come up on the bank of the river, they are met with concertina (razor) wire barriers. Governor Abbott is placing razor wire barriers along the border as an additional measure for border security. DHS Secretary Mayorkas ordered Border Patrol agents to cut the razor wire in order for the illegal immigrants to avoid injury.

The razor wire barriers are going up as a part of Abbott’s Operation Lone Star initiative. Operation Lone Star began in March 2021 when it became clear that Biden’s border crisis was not a temporary problem immediately following Biden’s election. Joe Biden had no intention of securing the southern border and he ignored pleas for federal resources from border governors. The crisis has only gotten worse the longer Biden is in office. Last month was the all-time worst for illegal immigration statistics.

A lawsuit was filed to get the Biden administration to stop cutting the razor wire. It costs Texas taxpayers when the razor wire has to be replaced, which DPS and Texas National Guard troops do immediately. Biden doesn’t care about Texas taxpayers. Texas is a big red state. He ignores Governor Abbott with impunity.

It cannot be stressed enough – Joe Biden does not care about the humanitarian crisis and the national security crisis he has deliberately created along the southern border.

Look at what Biden and his DHS did just days ago, before the judge’s ruling. THEY BROUGHT IN A FORKLIFT TRACTOR in response to the lawsuit in order to dismantle the wire barrier. That move allowed 310 people to illegally enter Texas. Texas Public Policy Foundation (TPPF) filed for the TRO, which the federal judge granted.

It’s unbelievable. The federal government is responsible for immigration and border security. The president’s first and most important responsibility is to keep Americans safe. Instead, Biden opened the border and now actively works against Texas as the state tries to secure the border, doing the job Biden refuses to do. He deliberately ended the successful policies and agreements used by the previous administration to secure the border. These are Biden’s policy decisions. It is easy to understand why someone like Bob Gates, former CIA Director and Secretary of Defense, a member of the GW Bush administration and the Obama administration, said that every foreign policy decision made by Biden has been wrong for decades. He hasn’t gotten any smarter or wiser with age.

The chief judge for the U.S. Western District of Texas set a hearing in Del Rio on November 7 on the state’s motion.

The order by Judge Alia Moses will be in effect pending the outcome of a hearing on Texas Attorney General Ken Paxton’s request that federal border authorities be barred from interfering with the miles of wire running along the Rio Grande near Eagle Pass pending the outcome of the suit he filed last week seeking to prohibit the practice altogether.

In an 11-page document filed in the with the federal court in Del Rio, Moses found that the state of Texas had met the required four-part test needed to be granted a temporary halt to the federal government’s action. Moses, appointed to the federal bench in 2002 by then-President George W. Bush, set a hearing on the state’s motion for Nov. 7 in Del Rio.

There is one exception granted in the judge’s TRO. That is medical emergencies.

“The Court shall grant the temporary relief requested, with one important exception for any medical emergency that mostly likely results in serious bodily injury or death to a person, absent any boats or other life-saving apparatus available to avoid such medical emergencies prior to reaching the concertina wire barrier,” the judge wrote in the court filing.

Last week, the Department of Homeland Security released a statement saying that border agents “have a responsibility under federal law” to protect migrants from being injured regardless of their legal status.

Silence the forklift tractors for now, Mayorkas. What a country. Instead of turning the illegal immigrants around and sending them back, Border Patrol cuts the wire for them so they don’t get injured as they invade Texas. Only in America.
