Texas sues Biden administration over new rule for immigrants

Texas Attorney General Ken Paxton sued the Biden administration on Thursday. This is something Paxton does on a regular basis. He has sued the Biden administration dozens of times and usually wins. In this lawsuit, he accuses the Biden administration of nullifying a Trump-era federal law that prevents immigrants from getting green cards if they are dependent on government social services.

In 2019, the previous administration expanded a rule that would allow immigration officials to deny green cards – permanent resident status – to those who previously received or anticipate in the future needing public benefits, such as Medicaid, housing assistance, food assistance, or other forms of taxpayer-funded help.

Paxton filed the lawsuit in U.S. District Court in Victoria. It claims the administration “seeks to further its open borders policy by enacting a new agency rule that effectively nullifies federal law excluding aliens likely to become public charges.” The lawsuit asks the federal judge to stop the use of Biden’s new rule. Since December 2022, the Biden administration has used its own rule, much like a 1999 policy, that defines a public charge as someone who is using public assistance or institutionalized for long-term care at taxpayer expense.

The rule restores the historical understanding of a ‘public charge’ that had been in place for decades, until the prior Administration began to consider supplemental public health benefits such as Medicaid and nutritional assistance as part of the public charge inadmissibility determination,” the Department of Homeland Security said in September when it announced its own rule. “The rule announced today speaks to the Biden Administration’s commitment to restoring faith in our legal immigration system.”

Simply put, immigrants coming to America have to be able to take care of themselves, not coming here with the intention of using public assistance as a means of livelihood. The previous administration knew it isn’t fair for illegal immigrants to expect different treatment than what immigrants legally applying for permanent residence are required to prove – means of supporting themselves. The State of Texas doesn’t want its taxpayers on the hook for public assistance for illegal immigrants, either.

As I mentioned above, Paxton has sued the Biden administration many times and he vows to continue to do so.

Since Biden took office two years ago, Texas has sued his administration more than 20 times, with most of the lawsuits focused on immigration policies. A majority of the lawsuits have been filed in courtrooms overseen by a Trump-appointed judge.

“I’ve sued Biden over a dozen times to secure our southern border,” Paxton tweeted on Thursday, adding, “I’ll keep suing & winning until he & his lawless Dems follow the law.”

Secretary of Homeland Security Alejandro Mayorkas, and other officials in the administration, besides Biden, are listed in the lawsuit. Paxton claims Biden broke the law by rescinding the Trump-era rule.

This is what Biden does – he halts every Trump-era plan, agreement, policy, and law in order to show he’s different than Trump. Thus, the Biden border crisis. Biden cannot find it within himself to admit how horribly wrong he has been in border security policy. He possesses an arrogance that will not allow him to say he was wrong about anything, even when his policies are killing thousands of people from fentanyl crossing the border each month or allowing people to die crossing the Rio Grande River, or continuing the basic humanitarian and national security crisis at the border. It is a dereliction of duty. He should be impeached for his negligence but Democrats will protect him. They don’t care.
