Justice Ginsburg was released from the hospital Sunday and 'Democrats are nervous'

Justice Ginsburg took a day off from oral arguments at the Supreme Court earlier this month. She was said to have a stomach bug and witnesses had noticed she appeared “shaky” the day before her absence. However, Ginsburg was back at work two days later and that seemed to be the end of it. But one week later, Ginsburg was admitted to Johns Hopkins with some kind of infection:

Justice Ruth Bader Ginsburg was admitted to Johns Hopkins Hospital in Baltimore on Friday night after experiencing chills and fever earlier in the day, a Supreme Court spokeswoman said on Saturday.

Justice Ginsburg was initially evaluated at Sibley Memorial Hospital in Washington before being transferred to Johns Hopkins for further evaluation and treatment of any possible infection, the spokeswoman, Kathleen Arberg, said in a statement.

Justice Ginsburg’s symptoms abated after treatment with intravenous antibiotics and fluids, Ms. Arberg said, adding the justice expected to be released from the hospital as early as Sunday morning.

Ginsburg was in fact released from the hospital Sunday and is said to be feeling better, but the two illnesses in two weeks is a “constant concern” according to the Washington Post:

Ginsburg’s health is a constant concern for liberals, who fear President Trump could replace her with a conservative justice. He already has chosen two members of the court, Justices Neil M. Gorsuch and Brett M. Kavanaugh.

Ginsburg has repeatedly swatted away concerns regarding her health. But the possibility that she will no longer be a formidable presence on the court is worrisome for liberal interests. If she were to leave, President Donald Trump would have the opportunity to shift the court further to the right by nominating a third justice, adding to the confirmations of Justices Neil Gorsuch and Brett Kavanaugh.

On social media, some progressives were turning to prayer:

CNN’s legal analyst Joan Biskupic was pretty blunt in her assessment of the news saying, “Yes, Democrats are nervous.” She continued, “First of all…she’s a hero to them so they want her to stay alive and well. She’s the senior liberal on the bench. If she were to feel the need to step down, it would transform this Supreme Court. But you know they’ve been anxious about it.

“She took a chance, a bit of a chance, when she declined to step down during President Obama’s tenure, which would have given him an opportunity to appoint someone younger while he was in office but she has felt a mission in her work and Democrats have just had to live with that.”

After two cancer scares this year and two illnesses this month, maybe it really is time for Ginsburg to think about slowing down a bit, but the pressure on her to remain in place is tremendous. Unfortunately, I guess we’re going to see her continue to fight this public battle to remain the left’s champion on the court.
