Bannon Files Emergency Appeal Before Reporting to Prison

Attorneys for Steve Bannon filed an emergency motion Tuesday in a bid to keep the former Trump White House chief strategist out of prison as he seeks to appeal his conviction for flouting a subpoena from a congressional committee that probed the Jan. 6, 2021, Capitol riot.

Bannon’s counsel of record R. Trent McCotter submitted the filing to the DC Circuit Court of Appeals requesting his client’s release before a July 1 deadline to surrender himself and serve a four-month sentence.

“If the panel decision stands, there will be far-reaching consequences, including separation-of-powers concerns,” wrote McCotter and other attorneys from DC firm Boyden Gray PLLC representing Bannon, 70.

It's absurd that Bannon and Navarro would go to prison over a separation-of-powers dispute, while Eric Holder and now Merrick Garland never even faced prosecution for identical contempt charges using the same argument (presumably with Garland). This is retribution, not justice.
