Newark Mayor Has Big Mad, Suing Over His 'Malicious' Arrest

Oh, my gosh - these guys just don't quit.

Remember at the beginning of May, when the Mayor of Newark and some potty-mouthed congresspeople tried to slam the gate doing ninety-eight for a supposed immigration facility spot check?

The folks at the ICE detention center in Newark were not amused.

Ras Baraka, Newark's mayor and a candidate for governor, was scooped up and arrested when the scrum got so ridiculous that the deputies had to start arresting people.

He went, but not without the obligatory posing for the cameras and crying out for someone to 'come see the violence inherent in the system/help, help I'm being repressed!'

Honestly. It was just like the movie.

Interim acting U.S. Attorney Alina Habba didn't note any specific charges at the time of her announcement of the arrest.

...Authorities have not yet confirmed the charges Baraka may face following the arrest. As of Thursday evening, no formal charges had been filed in state or federal court records reviewed by local outlets.

Towards the end of May, when Habba announced she was charging Congresswoman LaMonica McIver with assaulting law enforcement officers during the same visit, supposedly in an attempt to 'thwart' the arrest of Baraka, trespassing charges against Baraka were dropped.

New Jersey Rep. LaMonica McIver was charged on Monday for allegedly assaulting law enforcement officers outside of an ICE detention facility earlier this month, a move the congresswoman claims was "purely political."

Acting U.S. Attorney Alina Habba announced she was charging the congresswoman with assaulting and impeding a law enforcement officer.

On May 9, McIver, along with a few other members of Congress and Ras Baraka, the mayor of Newark, New Jersey, were protesting outside of Delaney Hall, a U.S. Immigration and Customs Enforcement detention facility.

...The complaint alleges McIver tried to "thwart the arrest" of Baraka after he had been told to leave the secured area of the facility because, unlike the congresspeople, he did not have lawful authority to be there. She is accused of making "forcible contact" with authorities, including allegedly slamming her forearm into a Homeland Security Investigations agent and pushing and using "each of her forearms to forcibly strike" an ICE officer, according to the complaint.

The complaint includes multiple stills from officer body camera footage showing what prosecutors allege were McIver's "multiple attempts to forcibly assault, resist, oppose, impede, intimidate, and interfere with the agents attempting to take the Mayor into custody."

The charges against Baraka were dropped by the U.S. attorney.

Well, Hizzoner filed a lawsuit against Habba today, claiming 'malicious prosecution' for the dropped charges coupled with 'false and defamatory statements' so that news footage of the 'Black Mayor' being led away in handcuffs made it to the evening news.

Newark Mayor Ras Baraka filed a lawsuit against interim U.S. Attorney for the District of New Jersey Alina Habba on Tuesday, accusing her of malicious prosecution over his arrest outside a U.S. Immigration and Customs Enforcement detention facility last month.

The suit seeks compensatory and punitive damages and is against Habba and the Department of Homeland Security special agent who Baraka claims unlawfully took him into custody on May 9 at Delaney Hall, where he was joined by three members of Congress for what they said they intended to be an inspection of conditions at the detention facility.

"The false Affidavit was made with malice, particularly seeking to assure that the evening news included videos of the Black Mayor of Newark, New Jersey being led away in handcuffs by federal officials," the lawsuit said.

I think he sees a big-time campaign ad coming, is what I think he sees.

Kind of a shame she didn't prosecute for the trespassing.

He gets to bust into anywhere he pleases and claim it's an 'abuse of power' if someone arrests him for trespassing.

And now he gets to enjoy all the free victim-hood publicity from having the charges dropped.

I'm not quite sure why they handed him this Golden Goose egg, but whatever. 

As Mary over at Legal Insurrection noted, the judge dropped Baraka's charges 'with prejudice,' so they can't be refiled the same.

...Habba’s office later dropped the trespassing charge after a judge lashed out at her over the arrest.

The judge also dismissed the charge with prejudice. Habba’s office cannot refile the same claim.

A New Jersey judge 'lashing out' at a Trump prosecutor?

Who cares? Or who should care? Maybe McIver's sins were more important and easier to prove, so they went with the lesser of two evils by letting Baraka fall away to chill the judge out.

But dang.

Not like Democrats aren't empowered enough - I don't know why we have to help them.
