GOP Rep. Fallon to file three articles of impeachment against Mayorkas as GOP takes control of the House

When the new speaker is chosen in the House, Rep. Pat Fallon (R-TX) is ready to file three articles of impeachment against DHS Secretary Mayorkas. Mayorkas was warned late last year that when Republicans took back the House, he should be prepared to face investigations into how he has managed his department and his handling of the southern border. Fallon was one of the Republicans who warned he faced potential impeachment.

Mayorkas was told in November by Republican lawmakers to either resign or be impeached. The Lt. Governor of Texas said that the Biden border crisis is an impeachable offense in December. The rhetoric from elected officials, especially those in border states dealing with the humanitarian crisis created by the porous border, has escalated in recent weeks. Fallon’s action will not come as a surprise to Mayorkas.

Dozens of House Republicans co-sponsored legislation to impeach Mayorkas in the last session of Congress. Fallon was one of those co-sponsors. The legislation went nowhere with Democrats in charge of the House and Nancy Pelosi as speaker. Fallon’s resolution cites similar reasons for impeachment.

“Since day one, Secretary Mayorkas’s policies have undermined law enforcement activities at our southern border,” Fallon said in a statement to Fox News. “From perjuring himself before Congress about maintaining operational control of the border to the infamous ‘whip-gate’ slander against our border patrol agents, Secretary Mayorkas has proven time and time again that he is unfit to lead the Department of Homeland Security.”

The first article of impeachment alleges that Mayorkas failed to execute the Secure the Fence Act of 2006. He is required by law to “maintain operational control over the entire international land and maritime borders of the United States.”

The second article of impeachment alleges Mayorkas is in violation of his constitutional oath. It alleges he “willfully provided perjurious, false, and misleading testimony to Congress.” In this article, quotes from Mayorkas during congressional hearings are included. In those quotes, Mayorkas insists that the border is secure.

The third and final article of impeachment alleges that Mayorkas “publicly and falsely slandered” Border Patrol agents in the infamous Whipgate case. That is when Border Patrol agents were falsely accused of whipping Haitian migrants in Del Rio, Texas in 2021 as they crossed the Rio Grande River into Texas. Mayorkas, it should be noted, at first sided with the actions of the Border Patrol agents and then quickly flipped his opinion to fall in line with Biden, Kamala, the press secretary, and other Democrats who showed no support or respect for the agents on horseback who all convicted the agents immediately of wrongdoing. What they did, however, was show their ignorance off how horse reins work and also their contempt for law enforcement along the southern border.

“The 511-page report by the U.S. Customs and Border Protection’s Office of Personal Responsibility found ‘no evidence that [Border Patrol agents] involved in this incident struck, intentionally or otherwise, any migrant with their reins,’” Fallon writes. “Secretary Mayorkas slandered his own Border Patrol agents and TXDPS Troopers involved in this incident, contributing to a further decrease in already-low morale among agents.”

DHS did not respond but it did respond in November when impeachment began to enter conversations.

“Secretary Mayorkas is proud to advance the noble mission of this Department, support its extraordinary workforce, and serve the American people,” the spokesperson said in a statement. “Members of Congress can do better than point the finger at someone else; they should come to the table and work on solutions for our broken system and outdated laws, which have not been overhauled in over 40 years.”

It’s legit to blame Congress for some of the mess at the border. It is its responsibility to pass legislation to make reforms to the immigration process. However, that fact doesn’t let Mayorkas off the hook. He does not enforce the current immigration laws on the books now. That’s on him and his leadership. He bends the laws as he sees fit without Congressional approval.

Here’s my two cents on the potential impeachment of Mayorkas – it won’t happen because Republicans only have the House, not the Senate, which will not vote for his impeachment. Joe Biden will not proceed to impeach Mayorkas, either. If there is impeachment over the Biden border crisis it should be impeachment of Joe Biden. It is his responsibility to keep America’s borders secure. Mayorkas, who has failed miserably in the job, is doing the bidding of Joe Biden. He is doing what Biden tells him to do, and that is to keep the border open. The Biden border crisis is intentional and it was Biden’s plan all along.

No one will be impeached over the Biden border crisis. Mayorkas and Biden will continue to do what they’ve been doing. Democrats are in charge of the Senate and they will not impeach either Mayorkas or Biden. That’s the reality. Republicans can make headlines and make the point that this crisis does rise to an impeachable level but it won’t matter in the end. We are stuck with the Biden border crisis for at least two more years. Hopefully Republicans will nominate someone who can beat Biden in 2024 and the border will once again become secure, at least as much as it was during the previous administration.
