DHS Officials: Biden's Promise to Shut Down the Border Makes No Sense

As you probably know, President Biden is still desperately trying to clear one of his major electoral problems off the table by reaching some sort of last minute border deal with Republicans in the Senate. Last Friday, Biden put forward his most Trumpian offer yet, saying he would completely shut down the border if Congress passes a bipartisan bill to allow him to do so.

“What’s been negotiated would — if passed into law — be the toughest and fairest set of reforms to secure the border we’ve ever had in our country,” Biden said Friday night. “It would give me, as President, a new emergency authority to shut down the border when it becomes overwhelmed. And if given that authority, I would use it the day I sign the bill into law.”

Biden, who has recently expressed optimism that a bipartisan deal could come soon, reiterated that the border is “broken” and argued that “it’s long past time to fix it.”

The idea that Joe Biden, who intentionally opened the floodgates at the border the day he took office and who is only now talking about it because it threatens to damage him in the coming election, is serious about shutting the border isn’t even worth talking about. I don’t think Biden care a bit about what is in this deal. What he cares about is some piece of legislation he can claim is solving the problem for the next 10 months at which point he’ll immediate revert to form and start listening to his leftist cronies once again.

But even if you really want to believe in Joe Biden the born-again border hawk, there are still plenty of practical problems with this new plan. Today, NBC News published an exclusive story talking to current and former DHS officials about those problems. First, here’s what’s actually in the proposed bill.

Two sources familiar with the negotiations said the bill under consideration would force DHS to shut down the border if the daily average for migrant encounters reaches 5,000 over a seven-day period or if the number of crossings in a single day hits 8,500.

During a shutdown, 1,400 undocumented migrants per day would be allowed to cross legally through ports of entry, but the restrictions would not lift until the number of migrant encounters decreased below 75% of the number that triggered the closure and then stayed below 75% for at least a week. DHS would then have two weeks to slowly reopen the border. That level of restriction could keep the border closed for months, the sources said.

Shutting down the border for months at a time. Could that work? In a word: No. At the moment, Biden is releasing about 85% of asylum seekers who cross the border into the country. From there they will probably be in the US for at least 5-7 years because of the current backlog. So what happens to all of those people if Biden shuts down the border? They all go back to Mexico in theory, only Mexico hasn’t agreed to take them.

One of the two former officials said Biden is sending a political message but not one that is based in logistical reality.

“You can’t shove back 8,000 migrants a day without the Mexicans’ approval,” the former official said. “What you would create is frantic surges in the weakened parts of the border.”…

“It seems to be strictly political,” the second former official said. “CBP and Border Patrol are pretty upset at this point.”

Remember, relatively few of the people coming across the border are Mexican. So closing the border doesn’t mean all of these people return home. It means they just pile up along the border creating a problem for Mexico to deal with. Many of these migrants won’t stay in Mexico though, even though they could apply for asylum there instead. But what they really want is to get a job in the US so that’s where they’ll keep trying to cross the border. Instead of making asylum claims, many might decide to just slide across the border illegally. What definitely won’t happen is that they’ll simply go away. At best, this is just piling up the problem for another day.

Are you shocked? Biden’s get-tough on the border plan is guaranteed to create more chaos and to fail almost as soon as it begins. It’s almost as if he doesn’t care. Again, all he really wants at this point is a talking point to last for a few months. If Republicans are really going to give him one, they might at least make him fix the problem he created.
