The Capitol Police released a statement Monday night in an update on the incident involving members associated with Stephen Colbert’s talk show on June 16.

The U.S. Attorney’s office then confirmed they would not be moving forward with the case because they ‘wouldn’t have been able to secure convictions’, according to a statement obtained by Axios.

Among the arrestees was Robert Smigel, best known for his character Triumph the Insult Comic Dog. Smigel, 62, who is a frequent guest on Colbert’s CBS show.
