The long and winding road to determine whether or not Texas has the right to secure its border continues. Supreme Court Justice Samuel Alito extended the ruling blocking Texas from enforcing a new law that gives law enforcement officers the ability to arrest and deport illegal aliens today.
Justice Alito handles emergency petitions to the Supreme Court in cases out of Texas, Louisiana, and Mississippi. He originally blocked Texas from enforcing a new law, Senate Bill 4, until Wednesday afternoon to give the Supreme Court time to study and rule on it.
The latest order from Alito gives SCOTUS until Monday to rule on Texas' right to enforce the law while a lower court considers the constitutionality of SB 4. That lower court is the conservative-leaning 5th U.S. Circuit Court of Appeals in New Orleans.
Biden's DOJ sued Texas in January to prevent SB 4 from going into law. Last month U.S. District Judge David Ezra ruled that SB 4 violates the Constitution and prior Supreme Court rulings. He said that in past rulings, the Supreme Court has confirmed that the federal government is in charge of immigration laws and restrictions.
SB 4 was scheduled to go into effect on March 5.
SB 4 allows local law enforcement officers to arrest and state judges to deport illegal aliens along the Texas border with Mexico. Lawyers for Governor Greg Abbott argue that the law signed by the governor is a valid response to President Biden's dereliction of duty. Governor Abbott declared an invasion was taking place along the border.
SB 4 is an extension of Operation Lone Star's work to secure the border. Governor Abbott began the initiative in March 2021 when it became apparent that the Biden border crisis was intentional and there would be no actions taken by the Biden administration to help Texas manage the invasion of illegal aliens. Texas taxpayers have spent billions of dollars on Operation Lone Star.
Governor Abbott has authorized many deterrents to illegal crossings, such as using razor wire and old shipping containers to line the banks of the Rio Grande River. He put up a buoy barrier system in the river to stop illegals from crossing through it. The Texas National Guard and DPS have been in charge of the land around Shelby Park since the governor seized that land. DHS was using the park as a staging area for illegal aliens when they were apprehended by Border Patrol. Most illegals just crossed the river and walked right to the park to turn themselves in.
The Biden administration has fought Texas on every action. Governor Abbott doesn't care. He is holding the line and doing Biden's job.
