Most of the rulings on First Amendment-related cases this term were speech-protective, even when they did not decide the overall merits of the claims. And in certain cases where they didn’t quite hit the mark, such as Vidal, the decisions were still made with an eye towards limiting the powers of the government to infringe the expressive rights of American citizens.

Sorry, but I think the weak punt on Murthy over standing is a more significant blot on the record than Vidal. In Murthy, the government had operated a clear effort to censor debate and dissent through its "jawboning" of social media platforms, of even more consequence than in Vullo. I'm happy with SCOTUS on containing the bureaucratic state, but it's a mixed-to-fail session for the First Amendment for punting on Big Brother.
