Supreme Court Justice Ruth Bader Ginsburg has issued a statement walking back some harsh comments she made earlier this week about football player Colin Kaepernick and others who have been protesting police shootings by refusing to stand during the national anthem. From Politico:

“Some of you have inquired about a book interview in which I was asked how I felt about Colin Kaepernick and other NFL players who refused to stand for the national anthem. Barely aware of the incident or its purpose, my comments were inappropriately dismissive and harsh. I should have declined to respond.” Ginsburg said in the statement.

Ginsburg made news earlier this week when she was asked about the protest and told interviewer Katie Couric, “I think it’s really dumb of them.” She added,” Would I arrest them for doing it, no…dumb and disrespectful.” She later said, “If they want to be stupid, there’s no law that should prevent it.”

Kaepernick responded to Ginsburg Wednesday, telling the Huffington Post, “it is disappointing to hear a Supreme Court justice call a protest against injustices and oppression ‘stupid, dumb’ in reference to players doing that.”

This is the second time in recent months that Ginsburg has apologized for making an inappropriate statement. In July she described Donald Trump as a “faker” and suggested she might move to New Zealand if he were elected. Then, as now, Ginsburg issued a statement a few days later saying she regretted making the remarks. She said at the time, “In future I will be more circumspect.” It seems like she’s still struggling with that.
