The three musketeers pander to DACA recipients ahead of presidential election

The three musketeers are pandering to DACA recipients in the run-up to the 2024 presidential election. They cannot legally vote but DACA recipients are an important part of the Democrat voting coalition because they are politically active and lend their voice to immigration legislation.

Thursday was the 11th anniversary of Deferred Action for Childhood Arrivals (DACA), a policy that allows certain individuals who meet program requirements to request a grant of deferred action. The recipients of the program are individuals who entered the country illegally, likely with parents, and are able to renew DACA approval, as well as eligible for work authorization. Obama initiated DACA with an executive order, though at the time he said he knew the action was not constitutional. His arrogance overcame him and the president that Democrats claimed was an expert on the Constitution decided to act against it in pursuit of a political win. It was a huge pander to Hispanic voters and others illegally entering the country.

Can DACA recipients become American citizens? Yes, in some cases. If their status changes, such as through marriage to a U.S. citizen, or moving from DACA designation to receiving a Green Card. Green card holders generally cannot vote in federal elections, but some states allow them to vote in local and state elections.

For Democrats, the goal is to allow DACA recipients to become American citizens and then they can vote. The “pathway to citizenship.”

Obama and Biden weighed in, too.

Immigration activists who do not distinguish between illegal immigration and legal immigration think all that is needed is some life stories by some DACA young people and heartstrings will be pulled hard enough to secure a pathway to citizenship for them. It’s no small number. There are about 800,000 DACA recipients in the United States. They may have all come as young people with their parents, their parents having made the decision to illegally enter the United States, and had no say-so in the decision, but that doesn’t change their legal status. Blanket amnesty, which is what a pathway to citizenship looks like, is not the way to go. It rewards bad behavior. The parents broke our laws when they came here illegally. They jumped the line on foreign citizens doing it the legal way and following the laws in place.

It is plenty reasonable to allow DACA recipients to reside in the United States as long as they follow the guidelines. However, it is not reasonable to allow them to receive a pathway to citizenship. Legal resident? Ok. Citizen? No. It’s just not right. They can stay as long as they follow the rules and lead productive lives. They should not be allowed to vote.

Biden’s border crisis is part of the mix now. More than 6 million apprehensions have taken place since Biden became president. Many of those millions are released into the country, some without so much as a scheduled court date for their asylum claims. Most are not eligible for asylum. They just know they can illegally enter the U.S. border and they will probably be allowed to stay. How long do you think it will be before they join in with other illegal aliens and demand citizenship?

The three musketeers are happy to encourage it. It is brazenly political and it is wrong for our national security and our rule of law. Trump tried to dismantle DACA but he failed to do so. DACA is back in the courts. A federal judge is expected to rule that the program is illegal for the second time. Of course it is illegal. Obama knew it was at the time he signed the executive order and said so. He just didn’t care. He wanted to do it and so, he did. He knew he would be out of office by the time it worked its way through legal challenges. There are more than 95,000 Texans enrolled in the program.

His initial ruling was appealed and the 5th U.S. Circuit Court of Appeals affirmed his decision but sent the case back to Hanen’s court after the Biden administration changed the program from one created via a memo by the secretary of the Department of Homeland Security to one enshrined in federal regulations.

DACA ended up in Hanen’s court because a coalition of nine states, led by Texas, filed a lawsuit in 2018 claiming that the program is illegal because the Obama and Biden administrations have given immigration benefits to undocumented immigrants that only Congress can approve.

In court last week, a lawyer for Texas argued that the nine states have had to spend hundreds of millions of dollars to provide social benefits such as health care and education to DACA recipients.

Now we wait for the ruling from Judge Hanen.
