This is mainly a rhetorical device, but it's still constitutionally ignorant. The tax cuts were passed by statute, which means that it will take Congress to repeal them. Harris has no authority to repeal them "on Day One" or any other day. That's not the ATR's point, which is mainly to contrast Harris and Trump on tax cuts. But it's still worth noting that Harris apparently hasn't ever taken a civics class ... or passed one, anyway.
