While the facts of the Biden case appear to have major differences from the Trump case, Hur’s conclusions are likely to face intense scrutiny from Republicans in Congress.

There are differences, but the fact remains that Biden violated the law in retaining classified material at his home, apparently recklessly stored in the garage to boot. Some of that material reportedly dates back to Biden's time in the Senate, when he had no custodial authority for such material all. The DoJ has a firm policy preventing it from charging sitting presidents, but in this case they should defer the charging decision to Biden's departure from office.
