[The argument is worth noting for its accuracy in making clear that it would take an amendment to impose this limitation. It might even make sense, as Goldberg points out at another point in this exchange that ex-felons can’t vote in some states unless a court restores that civil right. The argument has a couple of problems, however. Such a limitation might encourage even more banana-republic behavior by federal or state officials to attempt political convictions as a way to end political careers. That has already happened in Texas a couple of times (Tom DeLay and Rick Perry), so that risk is not hypothetical. In terms of this election, a constitutional amendment wouldn’t get passed in Congress and ratified by 38 states with the Trump case still unresolved before November 2024. — Ed]
