In England, courts enforce a far broader duty of confidentiality, upholding breach-of-confidentiality lawsuits against loose-lipped ex-spouses and lovers. Solove would like to see the United States move to a legal regime more like that one, so that we’re not held hostage by the questionable trustworthiness of our friends.
