Osundairo brothers file defamation lawsuit against Jussie Smollett's attorneys

“Let me make one thing perfectly clear,” Gloria Schmidt said at a press conference this morning, “the Chicagoan brothers told the truth.” Schmidt gave the press conference Tuesday morning to announce that her clients, the Osundairo brothers, had filed a federal lawsuit against two attorneys representing Jussie Smollett. “Attorneys Mark Geragos and Tina Glandian, through their continued false statements and hateful rhetoric, have only deepened the damage that was cause by the very first out of 16 counts of lies that were told to the police that started this whole situation,” said Gloria Schmidt, attorney for the Osundairo brothers.

The lawsuit alleges that, “Smollett directed every aspect of the attack, including the location and the noose” and that his attorneys defamed the brothers in statements to the media.

The lawsuit outlines several instances of Tina Glandian making comments to the media which state or imply the attack by the Osundairo brothers was real and not part of a plot concocted by their client Jussie Smollett:

Ms. Glandian insisted Mr. Smollett was innocent of making a false police report and falsely added that Plaintiffs criminally attacked Mr. Smollett.

Ms. Glandian then falsely submitted that Plaintiffs may have been wearing “whiteface” while attacking Mr. Smollett – again stating Plaintiffs battered Mr. Smollett and adding the implication that this battery was a hate crime…

Ms. Glandian’s statements indicating Plaintiffs actually criminally battered Mr. Smollett without his consent are patently false and defamatory, as Mr. Smollett originated, planned, and orchestrated the attack…

Ms. Glandian’s statements were made after the close of Mr. Smollett’s criminal case, did not serve any legal function, and was not a requirement of her job as a defense attorney.

Instead, these statements were unnecessarily made on national media to advance Mr. Smollett’s and Ms. Glandian’s reputation and fame at high cost to Plaintiffs.

Glandian also claimed, on a podcast, that one of the brothers had been sexually involved with Smollett:

On or around April 6, 2019, Defendant Tina Glandian further discussed Plaintiff Abimbola Osundairo (hereinafter “Bola Osundairo”) on the podcast Reasonable Doubt.

Ms. Glandian inferred that Bola Osundairo and Mr. Smollett engaged, at least briefly, in homosexual acts together. These statements were made to the third-party press and public.

Bola Osundairo is heterosexual and was dating a woman at the time.

Bola Osundairo has never engaged in any sexual acts with Mr. Smollett, thus Ms. Glandian’s statements are patently false.

The lawsuit claims the brothers lost professional opportunities as a result of these and other claims, including that they used steroids. It will be interesting to see how Smollett’s attorneys respond to this lawsuit. Will they come out and once again implicate the brothers in the attack or will they choose not to double-down now that they have been sued?
