The decision in Trump v. Barbara, which reaffirmed, by virtue of the 14th Amendment, that nearly all children born on U.S. soil are citizens at birth, pretty much shot down President Trump's attempt to squelch the citizenship issue.
In light of what SCOTUS handed down, which did still allow him some latitude for restriction by executive order, the President moved to avoid the constitutional issue and pivot to regulating the visa, travel, and beneficiary vectors.
In two executive orders, he hit what he could before a pregnant woman entered the country and the eligible categories, without tripping on the birthright pressure plate.
...Rather than revisiting the constitutional question directly, these new executive orders take a different approach. The first order sets out four categories of exceptions: children of “alien enem[ies],” including members of federally designated terrorist organizations; children of foreign government employees, a category that extends beyond ambassadors to embassy and consular staff who are foreign nationals; children born through “birth tourism” or surrogacy arrangements, including situations where individuals pay for or arrange a mother’s presence in the United States to give birth; and children born in certain U.S. territories where citizenship is not conferred by statute. Notably, exceptions for children of foreign diplomats already existed before this order under long-standing practice.
The second order targets so-called “birth tourism,” the practice of traveling to the United States for the primary purpose of giving birth so that a child will receive U.S. citizenship. The order directs the U.S. Department of State to strengthen visa screening procedures and identify applicants who intend to travel to the United States to give birth. The order instructs consular officers to deny nonimmigrant visa applications when they have reason to believe the applicant will engage in birth tourism. The order also calls on the U.S. Department of Homeland Security (DHS) to coordinate with the State Department on enhanced screening at ports of entry.
Notably, the order does not attempt to revoke birthright citizenship itself; rather, it targets the visa process for nonimmigrant travelers who enter the country specifically to give birth. The administration has framed this as a measure to protect the integrity of the immigration system rather than a challenge to the Fourteenth Amendment.
And birthright tourism is a big-money big deal, although I don't believe anyone had any concept of how big a deal it was until the Trump administration started shining a light on people paying to birth little American citizens.
In April, the feds busted a birth tourism ring where pregnant Chinese women were flying into California and, for 80 grand a pop, leaving with a little U.S. bundle of joy.

In June, Rubio's State Department exposed what they called a 'sophisticated worldwide network' that spanned half the globe, from every corner of Africa to Europe and China. They started revoking visas immediately and permanently banning 'fraudsters.'
The State Department has uncovered several birth tourism networks around the world, The Daily Wire can first report.
Under guidance from the State Department to be on high alert about fraudulent documentation, U.S. embassies in West Africa, Europe, and North Africa found evidence of multiple plans to produce fraudulent documents and facilitate individuals traveling to the United States to give birth within American borders, The Daily Wire has learned.
In West Africa, a U.S. embassy uncovered a “sophisticated birth tourism network” wherein more than 100 foreign nationals were using fraudulent documents to obtain visas and secure U.S. citizenship for their children. The State Department shut down this birth tourism network and revoked the foreign nationals’ visas. State is also coordinating with local authorities to “systematically identify and cut off any similar operations.”
“Under President Trump, the State Department is defending the integrity of U.S. citizenship by ending illegal birth tourism schemes,” said State Department messaging viewed by The Daily Wire. “No foreigner is permitted to obtain a visitor visa for the primary purpose of acquiring U.S. citizenship for a child by giving birth in the U.S.”
A U.S. embassy in Europe found that more than 400 suspected birth tourism cases had occurred since 2024. In this case, investigators traced the birth tourism to at least six companies that were coaching applicants on what to say in their visa interviews, arranging housing, and setting up delivery plans. State again shut down the process, revoked the visas, and permanently banned “several fraudsters from traveling to the United States ever again.”

And that's a legit question about hospital funding, to which I believe the answer is 'hay-yull, yes.' Any hospital with a birth tourism program should have its federal funding stripped so fast that the vortex sucks every vehicle in the parking garage right out.

The many stories about how widespread the tourist baby-citizen boom is have caught Congress's eye. Rep. James Comer's House Oversight Committee task force has been doing some digging and holding hearings recently.
Steven Camarota from the Center for Immigration Studies had a statement that put the numbers in perspective.

This, naturally, infuriated the members of the committee who are moving to legislatively shut the door on the practice.
...“The birth tourism industry engages in fraud and other criminal activity, threatens our national security, and costs U.S. taxpayers,” House Oversight Committee Chairman James Comer told the DCNF in a statement. “Our Committee’s Task Force on Defending Constitutional Rights and Exposing Institutional Abuses recently exposed this problem when the CEO of an entity promoting birth tourism repeatedly invoked the Fifth when questioned about his practices.”
“Another witness detailed how foreign nationals engaged in birth tourism exploit our immigration laws and drain taxpayer-funded resources,” Comer continued. “The Oversight Committee, alongside the Trump administration, will continue to fight these illegal practices, hold those responsible accountable, and restore integrity to our immigration system.”

...Republican Texas Rep. Brandon Gill is unveiling legislation to limit birthright citizenship for children of illegal aliens during a declared “invasion,” according to documents obtained by the Daily Caller.
Gill’s bill, titled the “Citizenship Act,” would clarify that the children of illegal aliens who entered our country as part of an invasion are not entitled to birthright citizenship under the 14th Amendment.
...In June, the Supreme Court ruled in Barbara v. Trump that children of illegal immigrants born on U.S. soil are U.S. citizens under the 14th Amendment, which grants citizenship to “[a]ll persons born or naturalized in the United States, and subject to the jurisdiction thereof.”
The Citizenship Act appeals to an exception the Supreme Court defined in 1898 when the majority held in United States v. Wong Kim Ark that “children of aliens within territory in hostile occupation” are not in allegiance to the country “whose domains are invaded.”
And although illegal immigrants are not the uniformed army of a foreign nation there is precedent for designating them as invaders.
Georgia congressman Rick McCormick is working the birth tourism angle with his legislation, hoping to pass a bill that closes the loopholes.
...That is why I introduced the Ban Birth Tourism Act in the House, with Sen. Marsha Blackburn leading companion legislation in the Senate. The bill is targeted. It makes foreign nationals inadmissible when they seek to enter the United States primarily to give birth and obtain citizenship for their child. It makes birth tourism a deportable offense under the Immigration and Nationality Act.
Critically, it does not go further than that. The legislation preserves protections for legitimate travelers seeking medical care. It does not affect lawful immigrants building lives in this country. It draws a clear line between people who respect our system and those who exploit it, and that distinction matters.

All this is welcome action, but for it to come to fruition at any stage, we must hold the House and Senate - it's as simple as that.
But there's one most aspect of this 'buy a citizen baby' that I had never considered, and while just too horribly cynical to absorb, it is all too real.
Surrogates are being contracted to be implanted with and give birth to American citizen babies under false pretenses through phony contracts.
This is so horrifying, as if the potential for surrogacy abuse wasn't already disturbing enough - this makes me wretchedly ill.
This gobsmacking CBS News story yesterday was the start of it.
Lured by an ad on Instagram promising a hefty payout, Andrea, an undocumented immigrant from Honduras living in California, decided to explore becoming a surrogate mother.
After some agencies expressed concerns about her immigration status, she found one that said yes. Before signing the agreement, she asked the firm, San Diego-based Creating Your Dreams Surrogacy, to set up a video introduction call with the young couple seeking to become parents. It was that call, Andrea said, that convinced her to make the complicated decision, as a single mother of two, to carry another couple's child.
"It was an opportunity to provide for my two daughters," she said. CBS News is withholding her full identity due to her immigration status.
But what happened after delivering the baby was beyond anything Andrea imagined possible.
After the birth, in October 2024, an elderly couple — people Andrea had never seen — arrived at the hospital to pick up the newborn.
"When the baby was born and they arrived at the hospital, it was a completely different couple," she said.
Worried about her immigration status and money she still was owed, Andrea handed over the infant and said she was paid about $40,000. The elderly couple took the newborn, and she never saw any of them again.
Ghastly, right?
California is the epicenter, if you can imagine, being the closest to mainland China and Taiwan.'
Oh, WHUT?
...Those insiders said they were aware of cases in which intended parents hired multiple surrogates in rapid succession. No federal agencies track these births. These whistleblowers, whose identities CBS News are protecting, said they believe the abuses cast a "dark shadow" over the assisted reproduction industry, harming dedicated professionals.
CBS News spoke directly with several surrogates like Andrea who met the intended parents only at delivery — or not at all.
Many foreign nationals travel to California when hiring surrogates. Dean Masserman, a partner at California law firm Vozimer & Masserman Fertility and Family Law Center said, "We have the most favorable laws and geographically, we are the largest state closest to mainland China or Taiwan."
It's a horrifying baby factory palooza, using mostly illegal immigrant women as broodmares on U.S. soil, and contracting with multiple surrogates for children at the same time.
But not just that.
Here's where the impact on AMERICANS comes in, and they know exactly which women to target who need the money.
And make no mistake about it - the money is insane.
...When a woman CBS News will identify as Judy, to protect her privacy, saw an ad on Instagram advertising surrogacy for $120,000, she signed up to become a surrogate. A single mom of a 7-year-old living with her father, she hoped to make enough money for a place of her own.
"I wanted to build a better life for me and my daughter," Judy said.
After signing her contract with the agency, Patriot Conceptions, she says she was told that the intended parent was a single father looking to expand his family. She said she asked how many surrogates he had hired, and was told the number was significant — close to two dozen.
"I can't be exact, but I know it was a large number and I just kind of sat with that information thinking, 'You know, that's a lot,'" Judy said. "That's a lot of kids at one time."
She said she felt bound by her contract, needed the money, and followed the advice of friends and family who urged her to keep moving forward.
Leaked documents obtained by CBS News named the intended father as Xu Bo. A Chinese billionaire and video game executive, Xu Bo has been reported to have over 100 children through U.S. surrogates, granting them American citizenship at birth. A former partner involved in a custody lawsuit against Xu Bo claims he has as many as 300 children.
...Judy said she has asked to meet the intended father at least five times, without success.
"It leaves me wondering: do I even have a right to know?" she added.
Xu Bo and his representatives did not respond to repeated requests for comment.
Patriot Conceptions also declined an interview. During a brief phone call, a representative asked if the surrogacy records were bought from the dark web and then cut off communications. CBS News obtained the Xu Bo contract through whistleblowers concerned about irregularities in the surrogacy industry.

Justice Sam Alito warned that adversaries are gaming birthright citizenship and exploiting it. Now picture hundreds of kids with American passports and loyalty questions hanging over Beijing. They can enter freely. Eventually vote. Maybe worse. Trump should not have to patch this alone.
Congress needs to pass a real law now. Stop the citizenship factory. Protect the republic.
