Court of Appeals rules Texas buoy barrier can stay up ... for now

The 5th U.S. Circuit Court of Appeals extended a reprieve for the 1,000-foot buoy barrier in the Rio Grande River at Eagle Pass, Texas. Texas can keep the barrier up for at least 3 more weeks.

The next hearing is set for October 5 on whether or not the buoy barrier is illegal.

Last week Judge David A. Ezra ruled that Governor Greg Abbott must remove the floating buoy barrier he deployed without asking for federal permission. Abbott’s deadline was today, September 15.

This week that deadline is no longer in effect. Governor Abbott expects the case to go to the Supreme Court, at least that is what he hopes. He wants the justices to have the chance to take a look at whether states can treat illegal immigration as an invasion and invoke their constitutional self-defense rights.

Abbott is at odds with the Biden administration over the southern border. Biden refuses to close it and Abbott insists that he has the constitutional right to protect Texas from invasion. Mexican officials are angry at Abbott for putting up the buoy barrier and razor wire along the border to stop illegal immigrants from crossing into Texas. Whatever Abbott tries to do to secure the border is fodder for Biden’s DOJ to go against Texas. Biden sides with the Mexican president over the Texas governor. It’s too crazy to be true, but it is.

Governor Abbott has made border security a priority since Biden opened it up to anyone who wants to cross the border. Texans and other border state residents put border security as a top priority as voters. Abbott’s initiative, Operation Lone Star, is funded by Texas taxpayers to the tune of $10B. Deployments of National Guard troops and state troopers help out at the border. Other red states send troops and personnel and equipment to aid Texas.

The Biden administration likes to say the southern border is secure and their policies are working. The reality is that the border is a humanitarian mess and a national security risk. People from around the world are pouring across the southern border without vetting and hundreds of thousands are ‘gotaways’, those who run from law enforcement and disappear into the country.

The situation is so desperate in Ajo, Arizona that the illegals are housed in cages. Hey, where’s AOC and The Squad? AOC better get her white pantsuit out of her closet and head there for some emotional photo ops.

Large numbers of single men from Africa are arriving in Arizona.

There are “freedom runs” now, according to the Border Patrol Union. DHS personnel in Arizona are using the term when instructing Border Patrol agents on mass releases of illegal aliens in Tucson.

The numbers are not out yet of the apprehensions at the southern border in August. There was a one-month dip in June and the numbers have come back up since then. Now the numbers are back to where they were last spring. Unprecedented and overwhelming Border Patrol agents and border communities.
