Mueller recommends Flynn face no jail time thanks to 'substantial assistance'

Flynn pleaded guilty to making false statements last year. Today, Robert Mueller released a heavily redacted memo recommending that Flynn face no jail time thanks to his “substantial assistance” to the Special Counsel. From Fox News:

“Given the defendant’s substantial assistance and other considerations set forth below, a sentence at the low end of the guideline range, including a sentence that does not impose a term of incarceration – is appropriate and warranted,” the memo states.

Flynn sat for 19 interviews with the Special Counsel’s office and other Department of Justice attorneys, according to the sentencing memorandum and a heavily redacted supplemental filing.

The documents do not provide specifics about what exactly Mueller has learned from Flynn, but they indicate he provided “documents and communications.”

Mueller’s addendum to the memorandum states that Flynn has “assisted with several ongoing investigations,” including a criminal probe. Further information about the probe appears to be redacted.

Of course, the thing that remains to be seen now is how President Trump will react to this news. He recently attacked his former attorney Michael Cohen as a “weak person” after Cohen pleaded guilty to false statements.

The other question is what comes next. Fox News also points to this Yahoo News story published Monday suggesting the Mueller probe is finally winding down.

Special counsel Robert Mueller’s prosecutors have told defense lawyers in recent weeks that they are “tying up loose ends” in their investigation, providing the clearest clues yet that the long-running probe into Russia’s interference in the 2016 election may be coming to its climax, potentially in the next few weeks, according to multiple sources close to the matter.

A former senior Justice Department official tells Fox News the deals based on false statements don’t suggest to him that Mueller has a strong hand with regard to collusion.

“It’s heavy on false statements charges, and that doesn’t suggest that it’s moving in the right direction for the prosecution,” Trusty said. “It doesn’t suggest to me that they’re making a lot of headway on the substance of their investigation which is Russian collusion.”

He added: “As an ex-prosecutor, false statements are a very distant second place.”

But the memo released today says that Flynn was helpful in the Trump-Russia investigation as well as a criminal probe, details of which are entirely redacted. So we’ll have to wait a few more weeks to see the results of Flynn’s (and Cohen’s) cooperation.
