McAfee Approves More Appeals on Fani's Status

Attorneys for a co-defendant in former President Donald Trump’s Georgia case will be able to argue that Fulton County District Attorney Fani Willis overstepped her authority by bringing election-related racketeering charges against him, according to a new ruling.

District Judge Scott McAfee on Monday granted a certificate of immediate review for Harrison Lloyd, a former leader of the Black Voices for Trump coalition, allowing him to request a review by the Georgia Court of Appeals. The decision by McAfee is surprising because it conflicts with previous rulings quashing procedural motions meant to deny Willis from pursuing certain crimes.

It's an interesting development, but not really a "brutal ruling," as Steffen suggests. McAfee hasn't made any ruling at all on the merits of these arguments, which he denied in the normal motions process. In Georgia, parties have to get permission to appeal such rulings before the end of the trial, although it seems a little pro forma as McAfee uses the process. All this does is allow Floyd to appeal now rather than at the end of the trial. 

This argument seems pretty weak, though, as Georgia considers DAs to be 'state constitutional officers.' I don't think jurisdiction is going to be an issue with the appellate court, but it probably doesn't hurt to run out every ground ball either.
