SCOTUS Ruling Kind of a (Non-) Drag

The Supreme Court on Friday declined to intervene in a case over a West Texas A&M student group's attempt to host a drag show on campus.

Spectrum WT, had sought to hold the March 22 event despite the university's opposition and has challenged the school's policy, citing the First Amendment, NBC News reported. The organization had sought an emergency order to permit that the event go on as planned, which the court declined to issue without explanation.

So much for the "shadow docket," eh? The issue here is whether Texas can ban drag shows on public grounds, and the Fifth Circuit will hear arguments next month on the challenge to the law. Apparently, the inability to hold a drag show on campus did not rise to the level of a constitutional emergency.

However, I wouldn't read too much into that. The court may still have a lot of problems with prior restraint on speech involving adults.
