BREAKING: Judge Quashes Six Counts in Georgia RICO Case Against Trump Et Al

Fulton County Superior Court Judge Scott McAfee wrote in an order that six of the counts in the indictment must be quashed, including three against Trump, the presumptive 2024 Republican presidential nominee.

But the order leaves intact other charges, and the judge wrote that prosecutors could seek a new indictment on the charges he dismissed.

The six charges in question have to do with soliciting elected officials to violate their oaths of office. That includes two charges related to the phone call Trump made to Georgia Secretary of State Brad Raffensperger, a fellow Republican, on Jan. 2, 2021.

It sounds as though these counts had some legal defect in the original indictment that will have to be cured. Dismissing them without prejudice means prosecutors can refile those charges under some other conditions that cures whatever defects McAfee saw in these charges. He didn't dismiss the RICO count, however.

We're still waiting for the ruling on the DQ motion. McAfee says he's reached his decision but needs to finalize his written ruling, and that it will come out no later than Friday. It's interesting that he chose to get this off his desk first. Maybe it's a sign that a new prosecutor will need to look at these charges?
