Dershowitz: Fani Willis Could Face Criminal Charges

“It does require disqualification, even on this record,” [Dershowitz] said, adding that Thursday’s evidentiary hearing will explore two facets: whether the hiring of Wade represented a personal benefit, which seems likely, and whether Willis or Wade perjured themselves when testifying under oath about their relationship.

“He allegedly stated under oath that their relationship became sexual only after he began working for her. If that’s not true, and there’s apparently a witness out there who’s willing to testify under oath that’s not true, we may end up having a criminal trial, but not of Donald Trump,” he added. “We may end up having a criminal trial of this couple for their perjury.”

Click over to watch the full segment. While Dershowitz is technically correct, I doubt that this would result in criminal charges. If Judge Scott McAfee determines that Willis lied in her filing, he'd almost certainly disqualify her and Fulton County from the RICO case and could dismiss the indictment. McAfee would also refer the matter to the Georgia State Bar for punitive action, likely a disbarment, for intentionally lying in a court filing. At that point, Willis would probably have to resign her position.
