[This is utter nonsense, and the Supreme Court will likely throw it out. A determination of “insurrection” has to be made in criminal court with full due process to the accused in order to become disqualified under the 14th Amendment, and Trump has never even been charged with that crime. Furthermore, insurrection is a federal crime, not a state crime, and Colorado’s courts don’t have any jurisdiction over actions that occurred (or allegedly occurred) in Washington DC. It’s judicial activism on steroids. UPDATE: My tweet response below. — Ed]
In other words, a state court has found Trump guilty of a federal crime with which he's never even been charged, based on informal allegations of unlawful conduct that took place 2,000 miles from the court's jurisdiction.
