NEW: SCOTUS Moots All Pending Cases on Vaccine Mandates in Military, Gov't

The justices tossed three cases Monday, two of which mandate challengers lost and one in which they won, and the high court ordered the lower courts to dismiss the cases, CNN reported.

Justice Ketanji Brown Jackson, the court’s newest member, dissented from the court’s action in two of the cases, saying that she disagreed with her colleagues’ decision to erase the lower court decisions in those cases.

[This is a mistake, although perhaps an unavoidable one based on precedent. The court should have allowed the cases to proceed to a final judgment, or failing that, left the precedents in each circuit standing to expedite review if the government tried to do something similar in the future. With the policies rescinded, though, the acute issues have been mooted, and that *generally* would produce this kind of decision. — Ed]
