The 14th Amendment theory is the perfect vehicle for the age of rage and Tribe, again, has supplied the perfect rage-filled analysis to support it.

[Turley had me at “Tribe,” really, but this is a good takedown of the bloviating talking head. Tribe attacked Turley for pointing out that this 14th Amendment idea lacks any limiting principle. but even more importantly, it also lacks any due process. In America we don’t deprive people of their rights without some form of due process in which a person can force the government to prove its case. Trump hasn’t even been charged with “insurrection” or “rebellion,” let alone convicted of it. Tribe is arguing for a process by which the State (or the states) can pre-approve candidates for office, somewhat akin to what the mullahs do in Iran, simply on the basis of preference or taste. That isn’t defending democracy — it’s *demolishing* democracy. — Ed]
