New: Trump signals removal motion in Georgia

Former President Donald Trump on Thursday notified the Georgia state judge presiding over his criminal racketeering case that he might seek to have the prosecution moved to federal court.

“President Trump hereby notifies the Court that he may seek removal of his prosecution to federal court,” Trump attorney Steven Sadow wrote in a court filing. Sadow noted that any such filing “must be filed within 30 days” of Trump’s arraignment.

[No surprise, really. Mark Meadows already filed such a motion and is waiting for a response. As a federal officer at the time of the actions in the indictment, Trump can apply for removal. The issue hinges on whether the actions alleged flowed from his responsibilities as a federal office holder rather than just as a candidate for office. Meadows probably has a stronger case, but that doesn’t mean Trump can’t win his either. The more that Fani Willis makes this look political, the more a federal judge might be inclined to grant removal, too. — Ed]
