RUSH TRANSCRIPT:
What did he do here or is this an example you might have a legal theory, is it a legitimate theory in light of what happened in 1960 with John Kennedy in Hawaii and alternate electors chosen?
>> This is criminalizing the challenge of elections. You have a Democrat prosecutor saying how dare you challenge a democratic victory? It’s been done before by Democrats. The whole case is based on the theory that Donald Trump didn’t mean it — even if that was true, the Democrats challenged Trump’s election on no grounds. Many of the past challenges were very, very thin. In Donald Trump’s case, he insisted he does believe that Georgia could have been flipped with a recount. The way she portrayed that phone call is really evidence of the bias and unfairness of aspects of this indictment. It makes perfect sense when you are challenging an election to say I only needs around 11,000 votes. If you — votes. That’s not a lot in Georgia. That’s not criminal. That’s making a case for a recount.
[Is Turley right? YMMV. Based on earlier transcripts of the January 2nd call, it seems as though Trump (a) thought something seriously wrong had occurred in Georgia, and (b) wanted the state to initiate yet another full recount and ballot review. That isn’t criminal, even if Trump DIDN’T think something wrong had happened … but there’s a bit more to it too. Georgia *did* do a full recount — multiple recounts in fact, completed weeks earlier — and found no change to the original outcome. That’s why The Call generated so much suspicion as to what Trump was really demanding … but suspicion ain’t evidence. — Ed]
