Former New Jersey Superior Court Judge Andrew Napolitano told Newsmax on Tuesday that the court’s requirement that former President Donald Trump post $200,000 bail in the Georgia election interference case doesn’t make sense.
“It’s absurd to require Donald Trump to post bail of any sort,” Napolitano said on Newsmax’s “American Agenda.” “He is arguably the best known human being on the planet. He really can’t flee anywhere without somebody recognizing him. He has so much at stake in this case, there is no way that he’s going to fail to show up when it’s necessary for him to do so.
“This is the prosecutor and the court sending a message to the president and the press that the former president will be treated just like any other defendant in the Fulton County Courthouse.”
[I tend to agree. Bail exists to disincentivize flight from prosecution. Trump is in the middle of a presidential campaign; where would he flee? And even if he was inclined to flee, a $200K bond is a laughable disincentive for Trump. A round trip on his plane probably costs more than the 10% it would take to use a bail bondsman. Why not just release him on his own recognizance for a non-violent indictment? — Ed]
