Gardner said that New Hampshire is unfairly squeezed by those dates, especially given his mandate under state law to set the primary at least a week before any contest that would undercut the state’s first-in-the-nation primary.

“If Nevada does not adjust its caucus date to a later time, I cannot rule out the possibility of a December primary,” Gardner wrote in his memo.
