Despite getting caught up in a criminal prosecution in California over its undercover investigative journalism, the Center for Medical Progress has not remained quiet. CMP has retained a former district attorney and a former deputy district attorney to represent them, Steve Cooley and Brentford Ferreira, and they have decided that the best defense is a good offense. Cooley and Associates has launched a new web portal to feature their legal defense of David Daleiden, and have published a “trailer” that outlines the content for which the state Attorney General has filed 15 criminal counts.
What precisely does the prosecution want to keep hidden? LifeNews provides some answers,but maybe it’s just as simple as hiding the jokes about eyeballs “rolling down into their laps”:

The video shows top Planned Parenthood staffers attending meetings of the National Abortion Federation in 2014 and 2015 and it is the latest in a series of over a dozen videos from the organization showing the Planned Parenthood abortion business and others engaging in potentially illegal sale of body parts of aborted babies.
The new undercover video shows Planned Parenthood executives and other top abortion advocates making shocking comments about abortions.
Several attendees made jokes about eyeballs from aborted babies and other aborted baby body parts “rolling down into their laps.”
Talcott Camp, a top pro-abortion attorney for the ACLU jokes: “I’m like — Oh my God! I get it! When the skull is broken, that’s really sharp! I get it! I understand why people are talking about getting that skull out, that calvarium.”
Dr. Ann Schutt-Aine, a Planned Parenthood abortionist, is show describing abortions this way: “If I’m doing a procedure, and I’m seeing that I’m in fear that it’s about to come to the umbilicus [navel], I might ask for a second set of forceps to hold the body at the cervix and pull off a leg or two, so it’s not PBA [partial-birth abortion].”
Meanwhile, Lisa Harris, the Medical Director of Planned Parenthood of Michigan, admits the unborn baby is a person: “Let’s just give them all the violence, it’s a person, it’s killing, let’s just give them all that.”
It’s impossible to know the context of that remark … in large part because the video is being suppressed by the state of California. Objectively speaking, Harris is correct: the fetus is a living person, and abortion violently ends its life. No one needs to “give” anyone that, because it is a scientific fact. Furthermore, the trade in fetal tissue from abortions corroborates that, because there would be no commercial value in lifeless, undifferentiated tissue from the mother.
One can understand why Planned Parenthood and the National Abortion Foundation wants to keep that — and their haggling over tissue sales — quiet. Steve Cooley and Associates wonders why the state Attorney General decided to join them:
It seemed odd that the Attorney General, then Kamala Harris, would take such action while a civil suit was pending in Federal District Court concerning the same journals and video-recordings. However, Public Records Act requests filed by SCA soon revealed the source of the Attorney General’s interest in what is truly a civil not a criminal matter.
The plaintiff in the civil suit, the National Abortion Federation (NAF) and its partner Planned Parenthood (PP), had importuned the Attorney General to initiate a criminal investigation into David in order to further suppress his undercover journalism. You see, David had exposed the most infamous and disturbing story of unethical and illegal medical practices since the Tuskegee Institute scandal-the harvesting and sale for profit of fetal organs, tissues and limbs from late term aborted fetuses. …
On March 28, 2017, the new California Attorney General, Xavier Becerra, announced that a complaint charging David and co-defendant Sandra Susan Merritt with 14 felony counts of illegally recording “confidential communications” under California’s anti-eavesdropping law, Penal Code section 632, and a 15th count of conspiracy to violate section 632. Arrest warrants had been issued but the complaint had yet to be filed. View the complaint and affidavit here.
Just as interestingly, the AG’s office refused to publicly identify the people who claim to have had their rights violated by Daleiden’s undercover work. SCA got a confidential list as part of the normal discovery process, but rejected the AG argument that these “Does” had a right to privacy. They’ve published the 14 names, some of whom are seen in the above video.
Clearly, SCA and CMP have decided to make this case as public as possible, and to put Becerra and Harris on the spot for bringing a felony prosecution for undercover journalism. Let’s see if it has a salutary impact.
