Straight to Jail, Jack Smith, Straight to Jail

Jack Smith, the illegally appointed Special Prosecutor whom Biden's Justice Department sicced on Donald Trump, is a perjurer. 

That should surprise nobody; for years now it has been obvious that he is a partisan hack with a burning desire to take down Donald Trump, which is why the Justice Department violated its own rules (eventually destroying their case) in order to appoint him. They knew they could count on him to break any rule, tell any lie, and cross every ethical boundary to get his man.

Well, now he has been caught violating the rights of Congressmen, the Constitution's Speech and Debate Clause, and committing actual perjury before Congress. 

Straight to jail. Straight to Jail. 

The revelation comes from Senator Grassley, who despite his advanced age, is still doing great work ferreting out wrongdoing. It was known for a while that Smith had played fast and loose with the rules and had dipped into text messages without following them, but Smith had denied that his fishing expedition had invaded the privacy of any Congressmen, which would not just be a no-no, but a quadruple no-no. 

Except...he did, and Grassley has the proof. And the list is loooonnnnngggggg. 

Smith has been on a media tour defending himself as more and more questions about his investigation have surfaced, but no amount of spin will save him if anybody has the cojones to actually prosecute the guy. 

Then again, maybe not. He would likely be tried in Washington D.C., where the jury would be filled with people who share his obsession with getting Trump.

Smith knew that what he was doing was legally questionable. He had established a working group called the "filter team" to ensure that they didn't violate any Constitutional provisions, but in the case of the text messages he bypassed them, got the messages, and had his team read them and flag anything he thought might be useful to get Trump

The special counsel’s office had established a so-called “Filter Team” to ensure they weren’t accessing privileged documents or violating officials’ constitutional rights when reviewing messages that had been sought from the National Archives and Records Administration (NARA).

Those Trump administration personnel included former White House Chief of Staff Mark Meadows, Dan Scavino, first daughter Ivanka Trump, Stephen Miller, Peter Navarro, current CIA Director John Ratcliffe, current FBI Director Kash Patel, Rudy Giuliani, Kellyanne Conway and then-Vice President Mike Pence.

The filter team was supposed to evaluate evidence obtained as part of “Project Coconut,” which was looking into Trump’s efforts to reverse the 2020 election, and “Project Cranberry,” which concerned Trump’s alleged hoarding of national security documents at his Mar-a-Lago estate.

An Aug. 21, 2023, internal DOJ email included in the records Grassley received shows that Smith’s team discussed directly obtaining “54 excel files with text messages from White House phones,” which were placed in a shared drive.

The DOJ revealed Tuesday that the special counsel’s office had accessed the communications between Trump White House personnel and lawmakers from both parties.

“All communication to/from the Filter Team must go through the Coordinator,” another DOJ document stated. “No materials shall be disclosed to the investigative team without approval of a filter team attorney.”

However, Assistant Attorney General Patrick Davis told Grassley in an accompanying letter Tuesday that Smith’s team “bypassed the Filter Team and directly accessed these text messages. The FBI then identified the people whose phone numbers sent or received the texts.”

If Smith were just any normal guy, you would expect that he would be strung up by the rafters. But because his target was Trump, any effort to prosecute him would be fought with the passion a pitbull has for human flesh, and unless he can be tried in Florida instead of Washington, D.C., the establishment jury would likely find him not guilty. 

After all, most of his victims were Republicans. Not all, though. Not all.

Perhaps I am too cynical. Perhaps, for once, one of the privileged will face justice for his sins. 

But I doubt it. 

There is another option that nobody would ever take: Congress, theoretically, has the right to imprison people for "inherent contempt," and this might be a stretch case. They could only jail him for the duration of a Congressional turn, and Smith would have be "tried" in the body that brought contempt charges on the accused. But it is theoretically possible for a house of Congress to jail a person for obstructing Congress

It would be hilarious, at least, to see Smith carried off in manacles.
