Video: CMP teases next release on StemExpress as TRO is dissolved

Yesterday, a court in Los Angeles finally dissolved a temporary restraining order against Center for Medical Progress that had kept the group from releasing any of its undercover videos involving the tissue broker that recently cut off its partnership with Planned Parenthood. CMP then promptly released a teaser from its Human Capital Project featuring a brief appearance by Cate Dyer, in which the StemExpress CEO says boxes shipping intact baby cadavers should come with a warning label. “Tell the lab it’s coming,” Dyer jokes, or they will “open the box and say, ‘Oh, God!'”

The Alliance Defending Freedom declared victory in the court fight yesterday:

The following quotes may be attributed to Alliance Defending Freedom allied attorneysrepresenting the Center for Medical Progress, regarding a Superior Court of the State of California decision Friday in StemExpress v. The Center for Medical Progress, which dissolves a temporary restraining order against the Center for Medical Progress, allowing them to release footage that features high-ranking StemExpress executives in California involved in selling fetal body parts:

“The First Amendment protects every American’s free speech, regardless of how damaging the truth is for scandal-ridden organizations like StemExpress and Planned Parenthood,” said Freedom of Conscience Defense Fund President Chuck LiMandri. “Our client has the right to expose StemExpress’ role in the potentially illegal sale of aborted babies’ body parts. The court was correct in lifting this gag order, which only served to protect StemExpress’ gruesome business.”

They may want to keep the champagne corked, however. The judge’s decision to dissolve the TRO also states that the court finds it likely that StemExpress will prevail in a lawsuit based on California’s all-parties wiretap law. The judge ruled that Dyer et al had a reasonable expectation of privacy, that this was not a public conversation, and that the recording therefore violated the law. Precedent, however, prevents the judge from restraining the release of the recordings, but the release will provide StemExpress with cause to sue CMP:

In other words, CMP has the right to speak — but StemExpress has a case when those videos get published. The judge did dismiss the idea that Dyer’s claims of safety threats did not override CMP’s First Amendment rights, however, which is what made the TRO curious from the start.

Presumably, we will see another video soon, perhaps as early as Monday, depicting more about StemExpress and its operating ethos. We’ve seen enough about Planned Parenthood to prompt states into action against the nation’s leading abortion mill, including Louisiana, where Bobby Jindal cut off Medicaid contracts with Planned Parenthood. Supporters of abortion gathered on the lawn of the governor’s mansion to protest that decision earlier this month, but in keeping with true Southern hospitality, Jindal provided them with some movies to watch while they demonstrated:

Oddly, they decided to retreat in the face of truth.
