Marco Rubio knows that the border is already secure, right?
Just this week Univision asked Sen. John McCain, R-Ari., “So let me ask you, on the plan that you are proposing, there is obviously a path to citizenship. This path to citizenship is actually based on the recommendation of a commission on border security. How would that work?”
McCain replied: “Actually it will be finally determined by the Secretary of the Homeland Security, because it is not constitutional to have any commission make decisions that are reserved for the Congress of the United States.” …
“Our borders have, in fact, never been stronger,” Secretary Janet Napolitano testified to Congress today.
So if our borders are already secured, that means all 11 million illegal immigrants can instantaneously get citizenship under the Rubio/McCain plan right?

Of course, our borders are not secure, but, this will not impact Rubio’s ‘instant amnesty’ plan – Rubio could care less about border security – he and the “progressive” GOP have a DREAM.

As I understand it, and please correct me if I’m wrong, but she doesn’t get to approve it until AFTER the commission approves it. So just because she’d approve it now doesn’t mean that it’s pre-approved.

How could a Republican vote for “comprehensive immigration reform” when agents aren’t even allowed to do their job right now? More laws promising enforcement aren’t going to change that.

McCain is saying that any commission formed by states representatives who are NOT congress or congressionally appointed are non binding on congress, and that Napolitano, who is already appointed by congress, has the sole authority to declare the nations borders secure.
Of course, if McCain were always right, Palin would be in her first term as President, having forced the old guy out of office.

It is not constitutional for a commission to make decisions reserved for Congress, but it is constitutional for a Cabinet Secretary.
What does this dirty game have to do with Constitutionality anyway?
The dirtiest good cop/bad cop game in Washington, which preceded Obama, is the game where the President of the USA refuses to enforce border and immigration law, while the Congress pretends it has no oversight over the Executive branch refusing to enforce laws which the Congress is too cowardly to repeal because they know the public would go ballistic. Their Joint Proposed Solution to the Problem of a public unwilling to erase the borders of the US, is to give amnesty to all lawbreakers, along with a voter registration card
