Why Palestine should take Israel to court in the Hague
Israel has categorized military clashes with the Palestinians as “armed conflict short of war,” instead of the police actions of an occupying state — thus freeing the Israeli military to use F-16 fighter jets and other powerful weaponry against barely defended Palestinian populations in the West Bank and Gaza Strip.
It has designated individuals who fail to leave a targeted area after a warning as “voluntary human shields” who are therefore subject to lawful attack, despite the fact that warnings may not be effective and escape routes not clear to the victims.
And it has treated civilian employees of Hamas — including police officers, judges, clerks, journalists and others — as combatants because they allegedly support a “terrorist infrastructure.” Never mind that contemporary international law deems civilians “combatants” only when they actually take up arms.
All of these practices could expose Israeli political and military officials to prosecutions for war crimes. To be clear, the prosecutions would be for particular acts, not for general practices, but statements by Israeli officials explaining their policies could well provide evidence that the acts were intentional and not mere accidents of war.

Who gives two green sh*ts for the World Court?
HondaV65 on January 30, 2013 at 11:53 AM
George, your a Palestinian-American Law professor, correct?
dmann on January 30, 2013 at 11:53 AM
Because as a useless gesture, it would fit in well with Palestinian Arabs’ MO?
JohnGalt23 on January 30, 2013 at 11:53 AM
Hey Georgey, you know what a war crime is: Strapping explosives on a body and murdering civilians. Or shooting rockets randomly into civilian areas for the purpose of murdering civilians.
Lance Murdock on January 30, 2013 at 11:57 AM
Because they can’t beat them anywhere else but in that mockery of a ‘court’ run by court jesters?
MelonCollie on January 30, 2013 at 11:58 AM
When the enemy is fighting a purely partisan guerrilla war there are no innocent civilians.
tommyboy on January 30, 2013 at 12:04 PM
The “World Court” can go ‘F’ themselves.
jake-the-goose on January 30, 2013 at 12:08 PM
Of course, this quack would forget that Israel is reacting to totally random acts of terror perpetuated upon IT’S citizens.
Jabberwock on January 30, 2013 at 12:13 PM
This guy has a long history of blaming Israel and holding the Palestinians entirely innocent.
aunursa on January 30, 2013 at 12:13 PM
Guess what, ‘tard? If the Israelis were not being showered with and killed by rockets from Palestinians, those “F-16 fighter jets and other powerful weaponry” would remain on the ground.
Take your Pallywood crap and shove it up your ass.
Resist We Much on January 30, 2013 at 12:14 PM
why cant israel take the Palestinians to court>
ChunkyLover on January 30, 2013 at 12:17 PM
In all honesty, I wouldn’t mind keeping the F-16s on the ground for the next round with Gaza.
Whenever Gaza hurls a rocket or a mortar over our way into our Israeli cities and towns, we should respond with the same cheep katyusha type missile technology, hundreds, no, thousands of them, into Pallyland’s population centers.
No more pinpoint guided missile targeting. Equal technologies and equal targets. Happy, Georgy boy?

Do squatters have some special protection in a European court? That begs another question, what jurisdiction does the hague really have any way?
Ellis on January 30, 2013 at 12:26 PM
More on the guy.
I find it fascinating that he’s of Palestinian Christian descent. Hey, George, how are the Palestinian Christians doing under Hamas??? Yeah, we know. It’s all the Joooos’ fault that muslims persecute Christians.
CJ on January 30, 2013 at 12:33 PM
Agreed. In Arab nations the benefit is almost nothing. They really will not hate us more if a couple of their
brood cattlewomen orjunior terroristschildren get blown up. That’s how much they ALREADY despise us.MelonCollie on January 30, 2013 at 12:38 PM
The court will, rightly, hold that teh Jooos are interlopers and occupiers and need to return to Poland and Germany, their real homelands…even the Ethiopian Joos. Or the court could just hold that the International Community should simply round the joos up and put them into “special camps” in the “”sandy wastes” of Russia or somewhere.
JFKY on January 30, 2013 at 12:47 PM
Sounds good on paper but the world would see it as Israel conducting terrorist attacks on civilians. Lets face it. Israel can do no good. It is as simple as that.

You can’t spell “Bisharat” without “Sh*t.”
Attila (Pillage Idiot) on January 30, 2013 at 1:08 PM
From what I understand and I could be wrong. Anyone convicted in the world court will face arrest if their country is part of the world court or arrest if they enter a country that is a member. If they found Israel guilty as a collective whole it would isolate them as their citizens would face arrest if they left the country and went to a country which is a member of the world court. That is one of the reasons that the left in this country so badly wants us to be part of the world court. Our officials and citizens could be found guilty of all manner of crimes and would be arrested here or abroad. Their wet dream is Bush finally being arrested for his war crimes.
Dr. Frank Enstine on January 30, 2013 at 1:09 PM
Added a word for accuracy.
AFAIK there are still pending war crimes charges against Chimpy, Cheney, Condi Rice and others.
One of those “others”? Colon Powell. But he was immediately forgiven by the Left in 2008 when he endorsed Dear Leader. Wonder if Billy O’Really asked him about that last night?
Del Dolemonte on January 30, 2013 at 1:32 PM
If we had fought WWII under all of today’s constraints on Western powers’ waging of war (if only our current enemies fought under the same rules of combat, huh) it would have certainly lasted another half-decade or more, killed many millions more people and led to far more destruction of cultural and historical treasures. Just stupid and suicidal not just to individuals but to entire nations and peoples.
deepdiver on January 30, 2013 at 1:34 PM
Note to anti-Semitic liberals: We will ALL be judged by the God of Israel. Maybe you should re-think your position on Israel.
Axion on January 30, 2013 at 1:36 PM
I understand why you’d think this, but you’d be wrong….
We were fighting the NAZI’s…the hated enemy of the Left, well after 1941, and between 1935-39, but sort of tolerated pre-1935…I get confused…ANY WAY…
And our ally was the USSR, a big favourite of the Left.
So in that case the Left’s be all for bombing Germany, Italy and Japan to cinders and killing hundreds of thousands of civilians, becasue they were FASCISTS.
It’s not about consistency, it’s about the Left and it’s enemies/friends.
JFKY on January 30, 2013 at 1:39 PM
I’m sorry, that is not politically correct.
Axion on January 30, 2013 at 1:41 PM

JFKY on January 30, 2013 at 1:42 PM
Understand that the Nazis fought the Communist in Germany too. But that didn’t mean their ideology was different, it was just a struggle for power.
Even Joseph Goebbels admitted that Nazism and Communism were basically the same thing… and in the AMERICAN spectrum of politics both Nazism and Communism are on the LEFT. NOT the Right, like liberals want you to believe.

They could, but everyone at The Hague hates them.

Uh thanks, I think the European History degree,as useless as it normally is, in this case did gives me the insight I need….
Anyway, NO nazism and Communism are NOT the same thing, in one man oppresses his fellow man and in the other it’s the other way around…COMPLETELY different. I can only attribute your confusion of the two with a False Consciousness, that needs to be eradicated thru a vigourous session of Ideology and Self-Criticism.

They are not alleged as far as the left is concerned. The WC would just be a formality before the public hanging.
Could be a smart move if BO ever pulls the trigger on joining the WC. Then again with all his drone strikes and Gitmo still open he could face charges himself. Nah, I’m crazy. BO can do no wrong in the eyes of the world. I plead old age for such stupid anti-BO thoughts.
Dr. Frank Enstine on January 30, 2013 at 2:29 PM
Well you can buy the lie if you like but maybe you should think about it a bit. Liberals say the RIGHT in American politics is akin to Nazism. Do you believe that? Do you think Ronald Reagan was like Hitler?
If Communism represents the far left and Nazism represents the far right… then where exactly are the good guys on the scale anyway?
Communism and Nazism are the same thing for all practical purposes, just change the uniform… both are totalitarian, that is their common thread. Whereas the RIGHT in AMERICAN politics is all about freedom, capitalism, Rights… all things that both Communism and Nazism abhor.
