Fighting for the little guy: Elizabeth Warren aided Dow Chemical against breast-implant claims
The Dow Chemical representation is yet another case in which Warren sided with big companies, along with Travelers and LTV Coal. Although the Globe did not include a link, Warren’s failure to disclose the Dow Chemical representation was exposed in my post, Elizabeth Warren issues incomplete list of cases based on Warren’s 2002 Affidavit in a bankruptcy case where she was hired to provide “professional legal services” (that case along with others also were not dislosed by Warren).
Since Dow Corning filed for bankruptcy in 1995 when Warren already was Cambridge, and this would be yet another legal representation Warren undertook from Massachusetts without being licensed in Massachusetts.
The Dow Corning bankruptcy was to protect against claims from women suffering the health effects of silicone breast implants manufactured by Dow Corning…

I dunno, I think the perpetually aggrieved just wanted a payout. Look at the Erin Brokovich case, after all was said and done, the town that got paid off with such a high payment actually has lower health problems than the surrounding areas where there was no supposed contaminants.

No good action can come without an unjust attack I guess.
Maybe I am missing the point. Maybe it is just the hypocrisy you are attacking. But in reality, not allowing unjust lawsuits against companies to prevail actually helps the little guy the most, as these lawsuits drive businesses into bankruptcy and increase the cost of everything they touch. Personally, a pretty lame attack.

I do not see much on the breast implant cases. So I am not certain, but I remember the number of times companies have been successfully sued and then later exonerated from actually having caused the harm in the first place.
If she was Republican, we would be defending her tooth and nail for having tried to protect a company from fraudulent lawsuits. We all know that these lawsuits hurt the consumer the most, not the companies. The companies will either go out of business, leaving the market bereft of products, or increase the prices to make up for the loss. It is one reason medical is so expensive.
Drug manufacturers have to include lawsuits into the price of every product, the companies that supply drug manufacturers have to include extraordinary measures and the cost of those measures to prove beyond any doubt that their product was pure. A similar thing happens with medical devices, test equipment, doctors and nurses, suppliers, builders, and everything to do with the medical profession.
So,I would just like this aspect to be part of the record on this thread. Not all lawsuits are bad, but there are many that are baseless and proven so by science.

After a bit of looking, it looks like the entire breast implant causes systemic body failure was based on the same science that John Edwards lawsuits were. Nothing but emotions and a few people who did not have awesome outcomes due to nature not being perfect.

Warren’s specialty is bankruptcy law; she’s not a litigator. She wasn’t in court arguing against the admission of junk science. Her role (most likely) was to help Dow protect its assets from creditors’ claims (at an hourly fee of $675). Not exactly the role one would expect from somebody who poses as a relentless advocate for consumer rights and champion of the little guy.

That is right, and this is one instance where I believe she was on the right side of the issue. But then again, she’s a lawyer, so they are paid to be on either side of any given issue.
