GOP challenges Obama on legality of new DREAM policy
Twenty Republican senators fired off a letter to President Obama on Tuesday asking a string of questions about the legal basis for the policy change.
“Not only do we question your legal authority to act unilaterally in this regard, we are frustrated that you have intentionally bypassed Congress and the American people,” Sen. Chuck Grassley, R-Iowa, and the other senators wrote. …
Rep. Steve King, R-Iowa, told Fox News Radio that he plans to sue. “We have to settle this issue,” King said. “And if we don’t take a stand here on this issue, then the door’s wide open for the president to do whatever he shall do with his presidential edicts.”

another cynical election ploy to divert attention from the economy and on to these race/gender/etc issues.
Republicans really need to find a long term solution to some of these issues. The democrats are going to keep punching us in the testicles as we really should do something about padding them. Romney is dodging… but it’s not ideal.

The Constitution specifically forbids the Executive Branch from deciding what laws it will and will not enforce.
Congress decides what is and isn’t law through legislation. The President can veto a law, but if it nevertheless becomes law he has to enforce it.

Does the DHS policy of NOT prosecuting illegal aliens, regardless of their situation, fall into a contempt of Congress issue?
After all, what is Congressional recourse if the Executive branch decides not to enforce legally constructed legislation?
What if Obama’s IRS decides NOT to collect taxes from people that make less than $60k per year, and to hard audit anyone who makes more than $100k?

You are correct. Executive agencies that were created by Congress fall under Congressional oversight, because they are all acting on BEHALF of Congress. No such agency can have any authority that Congress does not have because Congress created them.
So, yes, if JANET “deep voice” NAPOLITANO tries to override Congress and decide who is and isn’t illegal then Congress can hold her in contempt, hold impeachment hearings, basically whatever it wants to do.

Because if it were up to me, he reached that level long ago as a well as the Supreme Court justices who said they ought to look to foreign law for their decisions.

Good. If GOP leadership is emasculated, then time to bypass them and ultimately get rid of them. The issue is not immigration – it is complete disregard by the executive branch of the law and an abrogation of the Constitutional oath of office.

The first step would be to sack up and provide huge support for SB1070. After that, the states will fall in line and start sending illegal aliens arrested for crimes back to wherever the f**k they came from.
THEN we can start talking about potential “opportunities” for those who were brought here “against their will”. And no, a 15-year-old who hopped the border on his own and is now 29 does not fall under that category.

Simple discretion in the enforcement of laws may be a debatable tactic, but little Bammie’s new policies goes beyond discretion to include the issuance of a government document, some kind of ‘a work permit’. What are these permits, what legislation covers their existence, issuance, and numbers, including funding for same?
Creating new programs is far beyond simple discretion.

Clinton’s people damaged government property (removed ‘W’s from keyboards, etc.) and, I think, should have been fined, or whatever. And those people were sane compared to this administration.
Can you imagine what Bozo Barry will try to pull on his way out the door? He’ll have to be watched very closely.
