Why Obama’s attack on the Supreme Court is troubling
And yet, Obama’s assault on “an unelected group of people” stopped me cold. Because, as the former constitutional law professor certainly understands, it is the essence of our governmental system to vest in the court the ultimate power to decide the meaning of the constitution. Even if, as the president said, it means overturning “a duly constituted and passed law.”
Of course, acts of Congress are entitled to judicial deference and a presumption of constitutionality. The decision to declare a statute unconstitutional, Justice Oliver Wendell Holmes wrote in 1927, is “the gravest and most delicate duty that this court is called on to perform.”
But the president went too far in asserting that it “would be an unprecedented, extraordinary step” for the court to overturn “a law that was passed by a strong majority of a democratically elected Congress.” That’s what courts have done since Marbury v. Madison. The size of the congressional majority is of no constitutional significance. We give the ultimate authority to decide constitutional questions to “a group of unelected people” precisely to insulate them from public opinion.
I would lament a ruling striking down the individual mandate, but I would not denounce it as conservative justices run amok. Listening to the arguments and reading the transcript, the justices struck me as a group wrestling with a legitimate, even difficult, constitutional question. For the president to imply that the only explanation for a constitutional conclusion contrary to his own would be out-of-control conservative justices does the court a disservice.

Right. That is Obama’s “overwhelming majority”. 51.62% of the House voting in favor. Compared to a 5-4 decision to strike it down by scotus would mean 55% of the justices voted against.

First of all, he was never a “professor.” So there goes your credibility, Ruth – right out the window.
Secondly, what makes you think he understands how our government works? I have never seen any evidence of this, or that he appreciates the uniqueness of America. On the contrary, I really believe he despises America, and is working to make us just like Europe.

Because the Court can’t attack him back, ya dumbass. The Legislative and Executive branches both have a bully pulpit. They — and their surrogates — can meet each criticism tit for tat, each side can make their case, tear the others’ case down, and let the people decide in the voting booth. The justices of the United States Supreme Court cannot do that. They have to sit there and take Barack’s cheap shots with no response, which makes Barack a punk-ass coward. Believe me, if Justice Alito or Scalia could rip into Barack like he rips into them, little boy Barry would be keeping his fat trap shut because they would squash him like the ignorant bug that he is. Sheesh. Are you REALLY this stupid? Really?

On the other hand…
ObaMao is not merely objecting to the possibility of the SCOTUS overturning his signature piece of legislation, which is his right to do, but rather questioning the very legitimacy of the Court’s right to make a ruling. He can criticize the Court’s opinion but not imply that they are an illegitimate body who have no right to pass judgment on a piece of legislation.
Furthermore, the claim that they are “unelected people” is disingenuous. Each one of the justices was nominated by a POTUS who was elected. Each one was confirmed by a Senate that was elected. In fact, you could even say that each Justice was “elected” by a majority of voters, namely the Senators.
ObaMao is flailing about and the Left is stunned and dismayed. That’s what happens when reality (and Karma) come around and bite ’em on the you-know-what.
