Is it so much to ask that legislators take a constitutional law class before being sworn in? They take an oath to something they know nothing about, and don’t care to know anything about.

I have a feeling that too many people in charge of writing and interpreting legislation are waaay too buzzed up on it. Many need an intervention as they will never admit it to themselves.

The preamble answer is even worse. His initial answer was the ignorance of the moment, however he then comes back with the preamble, which gives no power to the government. So after he has a while to think about it, he still gives a piss-poor answer.

I would love to be on the Capital steps at High Noon today for the House Call on Congress. Since I couldn’t travel, I mailed 40 Democrat Senators pocket Constitutions, each with a post it note marked with pithy comment like, “Got Freedom?” and “Hey! These guys were pretty smart!” I made some personal. John Kerry is getting one that says, “Not Toilet Paper!” I sent Burris one that says, “Not Fundamentally Flawed!” That should be perfect now that I read that he cites the preamble itself as a mandate. Good grief! That shows exactly that he has fundamental flaws in his reading comprehension! Is there no one on their side to explain this kind of stuff to these people?

If the Preamble was all that is needed, why does the Constitution even have articles? The existence of Articles would seem to imply that they are what is important, not the Premable.
Looking at the words, the Preamble refers to the People ordaining and establishing this Constitution. That’s it. People. Ordain. Establish. Nothing else. It is not an executory clause but an explanatory one, and it’s work is finished with the ordaining and establishing–which was been done long ago. It is thus a dead clause.
It is an explication of what is to follow–the Constitution which has been so ordained and established. It is not the amble, it is the “pre”–before one takes a leisurely stroll through this Constitution, here is why is why the People established it–and oh by the way, it is established. It is executory in that sense only–the Constitution is established. Nothing else. It is not the executive summary, but the reasons before a candid world why it was done.
But, once again, the Preamble is not the Constitution. It is the transmittal letter, the cover sheet. The Constitution begins with Article 1. The proof of this is once again in that last sentence–”do ordain and establish this Constitution of the United States of America.” That is what the subject of the paragraph that is the Preamble is–not a description of the powers of the Constitution, but a notice that this Constitution has been established, and, if one cares, a description of the motivations of the people in so doing. It is not not not a summary of the new Federal Government’s powers.
Now, if folks of Mr. Burris’ ilk are ready to go for originalism in their defense of their interpretation, more power to them–but it will need to be a consistent viewpoint, applied throughout the document. I doubt they are ready for this.
I am afraid this time the Federal government will, will, will have to start learning it has limits. I thus leave with a quote by Shaw which I think best describes those of Mr. Burris’ acumen:
“you chaff and sneer and taunt them…And all the time you laucgh! laugh! laugh! Eternal derision, eternal envy, eternal folly, eternal fouling and staining and degrading, until, when you come at last to a country where men take a question seriously and give a serious answer to it, you deride them for having no sense of humor, and plume yourself on your own worthlessness as if it made you better than them.”
This is how revolutions are made.
