TikTok CEO: 'We Aren't Going Anywhere'

On Wednesday morning, President Biden signed into law a national security bill that would force TikTok to be sold by its owner ByteDance, or face a possible ban in the United States.

Minutes later, TikTok CEO Shou Zi Chew responded with a video posted to the platform, declaring that “rest assured, we aren’t going anywhere.” ...

“It’s actually ironic because the freedom of expression on TikTok reflects the same American values that make the United States a beacon of freedom,” he continued. “TikTok gives everyday Americans a powerful way to be seen and heard.”

As I wrote in another Headline yesterday, this isn't a freedom of speech issue. It's a commerce issue. The federal government has the authority to regulate international commerce as well as the authority to exclude foreign propaganda platforms from operating in the US. Anyone on TikTok can keep speaking just as they do now on other platforms, or on TikTok if ByteDance divests it and sells to owners with no connection to the CCP. 

It's still debatable whether this is good policy. But it's not a constitutional issue.
