So, they couldn’t put it in the mail? Or FedEx? They’re paying out millions in corporate subsidies – they couldn’t cough up $100 to send it overnight?

Given the timezone differences, overnighting it to Hawaii via FedEx/UPS/USPS would be too late. To have any chance of surviving a greedy Congresscritter’s lawsuit to get his/her pay raise, it needed to be signed before noon EST.

Of course, strictly speaking, that doesn’t matter. Because of how the 27th Amendment is written, that potential lawsuit would be successful no matter when, where, or how it was signed, and given the lack of severability, down goes the whole house of cards (I know, selective outrage from Roberts and his fellow Lawgivers-In-Black, but that’s how they roll).

So there are no computers in Hawaii? No fax machines? FedEx doesn’t deliver there? Why couldn’t the bill have been printed, faxed, or delivered to him there where he physically signed it, and then it was transported back to Washington? I doubt the validity of anything signed by “autopen”.

The Presidential mark has to be on THE copy enrolled by Congress, so no duplication is allowed.

As for the Autopen, while that has not been litigated, I believe its use would not invalidate an act if Presidential approval of its use on that act is otherwise sufficiently documented.

The question is, why is he so concerned about these political “victories”, especially when they’ll surely be pyrrhic ones once the, er, stuff really starts hitting the fan? He’s not running for anything anymore, and his legacy won’t be determined by how much of a wedge he was able to drive between the House GOP this time.

To me, it’s more ideological than anything else. He’s simply blind to the long-term consequences of these decisions.
