Black Philly teens who attacked white cabbie, passenger not to be charged with hate crime

When is a hate crime not a hate crime? When the skin color of the villain(s) and victim(s) doesn’t fit the paradigm that prompted the creation of hate crime laws in the first place.

Our friend Stephanie Farr of philly.com is back with the latest development in what she initially reported as “a horrific assault in Center City” in which “three teenagers who were spouting racial slurs pulled a man out of a cab to beat him.”

This time reporter Farr buries the lede only until the second paragraph, which follows:

The teens, who are black, were not charged with hate crimes because there was no evidence that the assault had been motivated by the race of the victims, who are white, said Tasha Jamerson, D.A. spokeswoman. Just shouting racial epithets during the commission of a crime doesn’t rise to the level of ethnic intimidation, she said.

Jamerson is quoted as saying, “They just didn’t have that in this case. If they had somebody who, two blocks before, heard them say, ‘We’re going to beat somebody up because they’re white, brown or purple,’ it might be different.”

But the first hate-crime legislation in the “modern era,” Section 249 of the Civil Rights Act of 1968, contains no such stipulation. In fact, the language of the law is pretty broad, covering “offenses involving actual or perceived race, color, religion, or national origin” and specifying punishment for

[w]hoever, whether or not acting under color of law, willfully causes bodily injury to any person or, through the use of fire, a firearm, a dangerous weapon, or an explosive or incendiary device, attempts to cause bodily injury to any person, because of the actual or perceived race, color, religion, or national origin of any person.

It would appear that the crime—in which the perpetrators hurled “racially derogatory names” at the cabbie and passenger and “punched … in the face, kicked … and threw a liquid” on the driver—meet the criteria for a hate enhancement as spelled out in the law.

Up came a memory of several years ago when a white college boy yelled out his window at a group of loud partiers on the lawn to please be quiet, they were making more noise than a herd of buffalos (close the statement). He was charged with a racial hate crime because most of the loud people were black, some of whom were students and some just visiting. I think I remember that the college suspended him!

The incident you refer to happened at the University of Pennsylvania in Philadelphia. One of the school’s law professors defended the student, who was eventually exonerated (possibly requiring the intervention of the federal court system, but I don’t remember).

Does it not? If three white teens yelling racial epithets pulled a black man out of a cab to beat him, and then beat the black cabbie, national news would have been all over this, and there would be outraged calls to prosecute the case as a hate crime. Can anyone doubt that?

tools like holder will NEVER consider gender in applying their faux PC unicorn justice. some of the most brutal, sadistic and hate filled crimes are those committed against females because they are female-no matter what their race, ethnicity or orientation. when one man like ted bundy can savagely murder over 30 women and one serial rapist can victimize scores of women-literally up to 100 in some cases- the toll of gender hate crimes is enormous -outnumbering officially labeled hate crimes by quite a stretch.

When white people lived in my neighborhood in the Bronx where I grew up It was functioning and for the most part safe. After 1970 it started to burn and now you simply risk your life if you walk though it. Is this a racist statement? TThe truth doesnt care.

Once more Filthadelphia even with a nutter as mayor… watches a city slide into ruin, racism and crime against white citizens. And under the criminal AG Holder ( I’ll never prosecute my people ) there will never be prosecutions against black racists and thugs. Gang bangers & flash mobs ( described as disaffected youts ) will now rule the streets in what once was….a great city that’s apparently joined the ranks of DC, Camden, Newark, Baltimore, Detroit, NYC, Cincinnati and LA.

Oh i don’t know about ALL that. I also grew up in The Bronx, a quick 10-15 minute walk from Fordham University campus. My neighborhood in fact was 90% Italian. I was only 1 of maybe 2 Black families, and frankly it wasn’t too bad at all. I even learned how to speak some Italian & play Bocci ball :o ).

That being said…there were incidents of violence, but that was mostly some of the wiseguys in the neighborhood taking “care” of things..not always to everyone’s benefit you understand? LOL

I wish somebody would have made Tasha at least go on record answering the question of what if the attackers had been white and the victims black. I’m sure she’d have a response that was equally ridiculous but she should at least have to make that statement and further demonstrate just how disgusting the hypocrisy really is.
