FBI confirms investigation into Hillary e-mail server

The FBI confirmed in a letter filed in court last week what nearly everyone already knew for months — that they have an open investigation into Hillary Clinton’s unauthorized home-brew e-mail system. The letter came as a necessarily belated response to a State Department inquiry last September into what the FBI was doing with the issue. At the time, the FBI played it close to the vest, but now there’s not much point in maintaining a pretense of secrecy.

Wall Street Journal reporter Byron Tau first broke the story on Twitter:

The timing on this development could not be worse for Hillary Clinton, who insisted on Thursday night that the FBI was simply conducting “a security review”:

Er, yeah … not exactly. Note the last line in the letter, emphasis mine: “[W]e remain unable to provide the requested information without affecting on-going law enforcement efforts.” A “security review” is not a law-enforcement effort; a law enforcement effort would follow a security review. In fact, the security review has been conducted by the Inspectors General at State and the intelligence community, which has found more than 1500 instances of classified information transmitted through and retained by the unauthorized and non-secure system Hillary personally put in place for her electronic communications.

Fox News’ Catherine Herridge and Pamela Browne debunked the “security review” claim from Hillary over the weekend:

Not true says Steve Pomerantz, who spent 28 years at the FBI, and rose from field investigative special agent to the rank of assistant director, the third highest position in the Bureau.

“They (the FBI) do not do security reviews,” Pomerantz said. “What they primarily do and what they are clearly doing in this instance is a criminal investigation.”

Pomerantz emphasized to Fox News, “There is no mechanism for her to be briefed and to have information about the conduct, the substance, the direction or the result of any FBI investigation.”

Separately, an intelligence source familiar with the two prongs of the ongoing FBI probe, stressed to Fox that the criminal and national security elements remain “inseparable.”  The source, not authorized to speak on the record,  characterized Clinton’s statement “as a typical Clinton diversion… and what is she going to say, “I’m 95 percent sure that I am going to get away with it?”

Fox recently learned that one of the FBI’s senior agents responsible for counterintelligence matters, Charles H. Kable IV, is working the Clinton case, another indicator the intelligence source said that the FBI probe is “extremely serious, and the A-team is handling.”

Indeed. The FBI might not be able to name its targets, but they’re making it pretty clear that they have targets to name, eventually.

Now that it is confirmed that the FBI is conducting ‘on-going law enforcement efforts’ with regards to Hillary Clinton’s private e-mail server, it’s time for the GOP Congressional leadership to get Congress to appoint an Independent Counsel to assist and support those ‘on-going law enforcement efforts’ as opposed to depending on the highly politicized Department of Justice.

The FBI does “security reviews” in the same way that the IRS calls you in to “review” your tax return.

Assistant director is actually the second-lowest management rank in the FBI, junior to associate executive assistant director, executive assistant director, associate deputy director, deputy chief of staff, chief of staff and special counsel to the director, deputy director, and director.

These are my thoughts as well. When was the last time any of the obvious law breakers were held accountable? FBI is like the Secret Service for me, they once had an air of professionalism and elitism, but after reading about lost guns, prostitutes, and epic security failures I think of them more like the IRS or VA or DHS.

I was a cop for 29 years and while I’m plenty Alpha…I think/hope, I always had great respect for the “cool guys” Secret Service/FBI. I once believed they were a cut above. We shall see.

Depending on the evidence released by the F.B.I. the next two or three months can be quite illuminating. Multiple felony-charges will NOT help Hillary’s Presidential campaign. Keep your eyes on Hillary’s aides. They are just as deep in this e-mail scam as she is. One of them may be thrown under the bus first. All of them now have multiple-layers of lawyers protecting them. Do not be surprised if the 5th amendment is used multiple times. We shall soon see if equal prosecution and protection shall extend to ALL layers of American-society.

Actually, being an AD is a big deal. That’s the guy running the entire division (Counterterrorism, CounterIntelligence, Criminal Investigations, etc.). At the EAD level, they’re running the Branches (National Security, Intel, Cyber, etc.). The Director, Deputy Director, and Associate Deputy Director all are out of the front office (it’s like Office of SECDEF for DoD, versus the Services).

FBI doesn’t count Chief of Staff and the related, as those are usually lawyers or other non-agents (if memory serves). Anytime you see those positions, they’re of importance, but they’re not as big as the agent-centric roles of AD, EAD, and the like.

I have every confidence the FBI does not want to ruin its reputation as objective investigators for Clinton (they didn’t get along when Bill was president).

However, I have NO confidence in DOJ doing their job. THAT’S where the holdup will be, my friends.

I’m not an attorney, but I assume Hillary can get information about the result of the FBI investigation at her arraignment or if she has to answer questions during her grand jury hearing.

That will allow Hillary to claim that the statement by Pomerantz was “not completely accurate”.

I’m no lawyer either, but I play one in my head.
(I read a lot of legal thrillers, ie. Grisham, Turow)

If I understand the set-up correctly:

Grand Jury? Not a hearing, per se. Prosecutor seeks finding of probable cause to indict. No.

Arraignment, Just an official reading of charges, and plea entered by defendant. No. (Sometimes motions are entertained by the Court, at the Court’s pleasure. I think. ymmv)

Pre-trial discovery, yes.
