Department of Education orders school to allow boys to use girls’ locker rooms, showers

Well, it’s official. (Or at least as official as something can be before a single judge or jury has a chance to look it over.) The Obama Department of Education has ordered a school in Illinois to toe the line on “transgender students” or have their federal funding revoked. The short version of this is that if a boy declares himself to be a girl he will now be able to demand to share the locker room and shower with your daughter, not to mention competing on the girls’ sports teams. From the New York Times:

Federal education authorities, staking out their firmest position yet on an increasingly contentious issue, found Monday that an Illinois school district violated anti-discrimination laws when it did not allow a transgender student who identifies as a girl and participates on a girls’ sports team to change and shower in the girls’ locker room without restrictions.

Education officials said the decision was the first of its kind on the rights of transgender students, which are emerging as a new cultural battleground in public schools across the country. In previous cases, federal officials had been able to reach settlements giving access to transgender students in similar situations. But in this instance, the school district in Palatine, Ill., has not yet come to an agreement, prompting the federal government to threaten sanctions. The district, northwest of Chicago, has indicated a willingness to fight for its policy in court.

The Education Department gave 30 days to the officials of Township High School District 211 to reach a solution or face enforcement, which could include administrative law proceedings or a Justice Department court action. The district could lose some or all of its Title IX funding.

Some of the headlines running around regarding this story are a bit misleading. One Reuters article went with the header of, U.S. orders girls’ locker room access for transgender Illinois student. That’s technically true, but it gives the impression that there’s been some sort of judicial determination. Keep in mind that this was simply a decision handed down by a single office inside one cabinet level department, namely the U.S. Department of Education’s Office for Civil Rights. This decision came from Assistant Secretary for Civil Rights Catherine Lhamon and she wouldn’t have issued the order if the President wasn’t fully briefed and on board with the ruling.

Aside from the questions of propriety and privacy, this ruling also seems to codify the idea that “transgender students” can compete on the sports teams designated for the opposite gender rather than their own birth gender. This just brings back memories of Renee Richards, who “transitioned” from being a man to a woman and then proceeded to crush the competition in women’s professional tennis despite being a mediocre at best competitor in the men’s ranks. Following a successful lawsuit, Richards was actually allowed to play for a few years until retiring and was ranked as high as 20th in the world. Similar questions arose in 2010 with a transgender athlete on the basketball team at George Washington University.

There is no end to the problems which arise from this nonsense and Township High School District 211 may wind up being the one to go to court and obtain some sort of resolution. This debacle started when we began humoring people who were in denial of abject reality because as soon as you start telling someone they can simply be whichever gender they “feel like” that day you are on the path to lawsuits and demands for special treatment. That’s led us down the primrose path to this decision from Obama’s education department and now the parents and the students in any number of schools are going to be paying the price for it. Hopefully a court will restore some sanity to this situation, but I’m not holding my breath for that either.

The simple answer to this problem is for the school to start just saying no to federal funding. That is the only power that the feds actually have in public schools. Public schools always complain about federal mandates, but when told to just refuse the federal money, they just whine that they can not function without it. Will they ever realize that the price of accepting that money is to do things that do not really improve learning by students. Of course, they are liberals, so they can not do that.

Correct me if I’m wrong, but in the past, if a male walked into a girl’s locker room/showers naked, wouldn’t he be arrested for indecent exposure, then sued by the girls’ parents for the psychological trauma? I don’t think that claiming “I’m transgendered” would be a viable defense, regardless of this idiot at the Department of Education’s ruling.

Umm, that pesky 16th amendment. Like it or not, when the ability to directly tax the individual was authorized, so was the right for the gov’t to set up the IRS to administer it.

The same holds true with the Post Office and the Military, once enumerated, the authorization to administer those functions is likewise.

Public schools always complain about federal mandates, but when told to just refuse the federal money, they just whine that they can not function without it. Will they ever realize that the price of accepting that money is to do things that do not really improve learning by students. Of course, they are liberals, so they can not do that.

The problem is that they need that money to cover the cost of paying unionized teachers’ salaries and pensions. Then you have districts where there are multiple layers of administrators that never even set foot in the classroom, yet earn big bucks at taxpayer expense. This is what happens when there’s little competition to force efficiency.

There’s a famous case in the Title IX saga where Grove City College, PA (small Christian school*) was sued by the big bad Feds in the 80’s (under REAGAN) to comply with the edicts (because of federal money coming to their school via loans).

Grove City lost the case, but then GAVE UP their teat to the gubmint money. Since then, they have FLOURISHED.

*both my daughters went there, loved it, got a good education and now are gainfully employed and serving the Lord.

What they’re doing is training young people to be sexual fiends in grade and high school, so that when they enter young adulthood they find themselves knee deep in sexual scandal after engaging in the very kinds of sexual activities they were trained to.

It’s one of the methods that the Collective is using to protect itself against “counter-revolutionaries.”

Obviously someone who was embroiled in sexual scandal at the very start of their adult life would be less likely to boldly combat them.

I was in middle and high school almost 30 years ago. The locker rooms had showers, but nobody used them. They must have been representative of an earlier era.

If I were elected President I’d simply refuse to appoint anyone to any department that is not within the Enumerated Powers. And I’d issue an EO (a proper, legal one) that there are to be NO MORE HIRINGS in these departments, and that all regulations ever issued by them are Void.

So, until Congress struck them they’d be sitting in their offices doing nothing. (which is mostly typical for government workers anyway, thank God)

I’m sorry, but they can pass any laws they wish, or try to impose their perverted will on the sheep of the left, but if a man follows my wife or daughters into the restroom or locker room, I will be in right behind him to show him the exit and to explain that he needs to either use the men’s room or a tree. I’m sure I will be able to convince him that it is his best interest to behave like a man, unless he wants to lose the equipment between his legs, without anesthesia. Moreover, I have no doubt that any high school boy who is confused about his gender and goes into the girls restroom or locker room will have a similar private conversation with the other boys who are not confused. Then we’ll let a jury of our peers sort it out.

I would encourage a group of boys in each school to “decide” that they are “girls” and therefore eligible to be on the girls sports teams. Pretty soon there will be few girls on the teams. Won’t the feminists love that?

Years ago, my mother worked as the receptionist at a non-union construction company. Company had done work for a local library in the past, but when the library went to expand, it applied for and received a Federal grant. Mum’s company didn’t even bid the job because they didn’t want the hassle of complying with the strings that came with Federal money (prevailing wage, etc.). The head of the library was disappointed because it was a company with a good reputation.

For grins one day, my mom figured out what her company would have had to charge (to comply with the regulations) over and above what they’d have normally charged. You guessed it. Turns out the Federal money actually cost the library because they ended up spending more to comply with the Federal regulations than the value of the grant.

This is precisely what we were told would never happen when the Department of Education was created in 1979. It’s an extortion and union protection racket designed to undermine local and parental authority, just as predicted 36 years ago. And it has done absolutely nothing to improve anyone’s education. There’s no department that deserves to die more than this one.

Liberals seem to be unable to comprehend the consequences of their beliefs/policies/desires. Sometimes I don’t think it’s a bad thing to push it to the extreme to show them what they have engineered.

No doubt though they would figure out a way to “shame”, demean and punish these boys, just as they will find ways to cover up sexual abuse/rape that happens BECAUSE of their belief that boys in girls locker rooms is a good thing.

How do they reconcile this with their screaming rape culture? In their world, normal boys are only rapists in training, so how could they think of allowing a girl who identifies as a boy into boy’s bathrooms/locker rooms? My head hurts.

They don’t.

What they’re doing is training young people to be sexual fiends in grade and high school, so that when they enter young adulthood they find themselves knee deep in sexual scandal after engaging in the very kinds of sexual activities they were trained to.

It’s one of the methods that the Collective is using to protect itself against “counter-revolutionaries.”

Obviously someone who was embroiled in sexual scandal at the very start of their adult life would be less likely to boldly combat them.

Correct me if I’m wrong, but in the past, if a male walked into a girl’s locker room/showers naked, wouldn’t he be arrested for indecent exposure, then sued by the girls’ parents for the psychological trauma? I don’t think that claiming “I’m transgendered” would be a viable defense, regardless of this idiot at the Department of Education’s ruling.
