Clinton vs. Clinton: Bill’s spokesman says he never e-mailed Hillary

Her core reason yesterday for deleting personal e-mails and refusing to turn over her server is that there are/were private communications on there, including between her and Bill, and no one has a right to see those. Now here’s Bill himself saying nope. Say what you will about Frank and Claire Underwood, at least he’d never leave her twisting in the wind in the middle of a scandal.

But wait. These are the Clintons. Every syllable must be parsed and re-parsed for hedging. Typically they don’t proceed to an outright lie until they’ve been cornered on their lawyerly non-answers. What exactly did Hillary say yesterday?

“The server contains personal communications from my husband and me,” she said. “The system we used was set up for President Clinton’s office,” she added. “So, I think that the use of that server, which started with my husband, certainly proved to be effective and secure.”…

But some took “from my husband and me” to mean messages between the former president and first lady…

Asked whether Bill Clinton e-mailed with his wife at her e-mail address, McKenna told Bloomberg he did not. 

Perhaps Hillary Clinton meant messages on behalf of both of them.

Aha! So she didn’t explicitly say they e-mailed each other, only that messages were sent from the two of them. (E.g., “Best regards, Bill and Hillary”?) Or maybe Bill never e-mailed Hillary but Bill’s secretary did, after he told her what the message should say, which in ClintonWorld doesn’t really count as him e-mailing her just as sex acts that don’t involve coitus don’t really count as “sex.” Gotta be one or the other: I can’t imagine why Bill would hang Hillary out to dry by seeming to contradict her when she’s already getting nuked in the media for her ridiculous spin yesterday.

The e-mail contradiction isn’t the only case where Hillary might have chosen her words carefully. Sean Davis spots Clintonian evasiveness afoot in how she responded when asked about e-mailing with Obama and the security of her server. Here’s what she said:

CLINTON: I did not email any classified material to anyone on my email. There is no classified material.

So I’m certainly well-aware of the classification requirements and did not send classified material.

You could take that at face value if it were most anyone else, but for Hillary, says Davis, we need to scrutinize verb tenses. There “is” no classified material on her server, great. But was there? Much depends here on what the meaning of the word “is” is. Nor does she say anything about “sensitive” information, one rung down from classified info on the secrecy ladder. And note, he continues, how she says — twice — that she never sent classified information but says nothing about having received any. That’s probably no accident: Per Morgen Richmond, State’s ops center beams out classified alerts to key personnel 24/7.

Diplomatic experts, when interviewed by the NYT, essentially laughed at the idea that she wouldn’t have been receiving classified information via e-mail. “I would assume that more than 50 percent of what the secretary of state dealt with was classified,” said one former senior State official. At worst, she lied outright yesterday; at best, she told the truth in a way so evasive and misleading that you’d need a lawyer with Davis’s eye for detail to interpret her answers for you. Either way, given how pitiful the security of her server was/is, it’s a cinch that foreign spies were accessing State’s confidential communiques through Clinton’s set-up. This person is the prohibitive frontrunner for the Democratic nomination.

The only way we’re going to get answers is to put her server in the hands of independent analysts. Can the deleted e-mails be retrieved? Can the saved e-mails that weren’t turned over to State all be rightly categorized as personal and therefore not subject to disclosure? Trey Gowdy told MSNBC this morning that his committee has no power to subpoena personal property like the server; the whole House might have that power — a court would need to decide — but Boehner’s not going to go down that rabbit hole given how the last confrontation between House Republicans and a Clinton shook out. To access that server, either Hillary’s going to have to be charged with something or, in the name of good government, transparency, and turning over a new leaf, she’s going to have to voluntarily turn it over. Which is a long way of saying she’s going to have to be charged with something.

Trey Gowdy told MSNBC this morning that his committee has no power to subpoena personal property like the server; the whole House might have that power — a court would need to decide — but Boehner’s not going to go down that rabbit hole given how the last confrontation between House Republicans and a Clinton shook out. To access that server, either Hillary’s going to have to be charged with something or, in the name of good government, transparency, and turning over a new leaf, she’s going to have to voluntarily turn it over. Which is a long way of saying she’s going to have to be charged with something.

The server is meaningless. Hillary will never hand that over with incriminating e-mails on it. It’ll either have mysteriously crashed like they do at the IRS or it’ll be missing anything of interest to Gowdy.

The only way to nail Hillary on this is to track down e-mails through recipients. The question is does Gowdy have the right to subpeona those records(and have they not been scrubbed either) and if not, can and will the House go after those?

Worst case scenario, she needs to be hauled in front of the committee and raked over the coals. If she’s gonna tell stupid, blatant lies, at least make her do it on national TV under oath.

It was set up a week before her SoS confirmation hearings started. Eight years after Bill was out of office. It was set up for her, not Bill.

The only way we’re going to get answers is to put her server in the hands of independent analysts. Can the deleted e-mails be retrieved?

The hard drives have been replaced and the excuse is that it was part of a normal upgrade cycle. The old drives have been disposed of in a manner consistent with normal State Department guidelines, which can’t be talked about for security reasons (i.e., they are at the bottom of the Hudson River somewhere.)

Take Hillary at her word. She said the server was the one Bubba had had installed in his office whenafter he left the White House. That server is in his office at 55 W125 Street NY,NY. Supposedly an IT expert has tracked the server’s IP address to a Manhattan location. If she used Bill”s server then she has a problem. That server is property of the GSA. It was provided to, not given to, Bill Clinton. It is in a location whose physical security is provided by the Secret Service. If my conjecture is correct, it’s not her property. It’s ours. And its contents.

I was intrigued last night on Greta, when she had a tech guy on who said the IP address is not in Chappequa. This is really neat if it is true, because the guy was able to ping that machine and tell where it is. He said it was in NYC. It might be a government server. That might CYA for the Clintons, regarding classified materials, perhaps? but it also means there might be more archiving there, that nobody scratched with a pin, when they were doing up Chelseas hair for the wedding.

Odds are every exchange, verbal or written, a Secretary of State engages in with regard to “her work” is routinely declared classified information by the U.S. government.

I went through the technical aspects with Axe on Twitter last night so I won’t repeat it here but suffice it to say with 2+ YEARS to sanitize the emails and hardware – there is NOTHING to be found on “the Secret Server”.

Pop Quiz: How EXACTLY does someone identify the server used for the emails? Or find the raid array which “still has the deleted emails” so they can be recovered?

For my money, the emails are Hillary’s red herring.

Sec. 1.2. Classification Levels. 
(a)   Information may be classified at one of the following three levels:

(1)   “Top Secret” shall be applied to information, the unauthorized disclosure of which reasonably could be expected to cause exceptionally grave damage to the national security that the original classification authority is able to identify or describe.
(2)   “Secret” shall be applied to information, the unauthorized disclosure of which reasonably could be expected to cause serious damage to the national security that the original classification authority is able to identify or describe.
(3)   “Confidential” shall be applied to information, the unauthorized disclosure of which reasonably could be expected to cause damage to the national security that the original classification authority is able to identify or describe.
(b)   Except as otherwise provided by statute, no other terms shall be used to identify United States classified information.
(c)   If there is significant doubt about the appropriate level of classification, it shall be classified at the lower level.

As you see in (b), no terms other than Top Secret, Secret and Confidential shall be used to identify information which has been classified. It doesn’t matter if the title is “Classified National Security Information.” This is the Clintons we’re talking about.

I have no doubt they’re playing with words, like the definition of “is” – but “classified material” is a perfectly valid generic or umbrella term for any/all classification levels. In the DoD world, we’re always talking in terms like “put away your classified”, “properly store your classified”, and so on.
Use of a phrase like “classified material” is not the point to make on this issue.
I would put the emphasis of concern about her comments on “there IS no classified” – as in she already deleted it – so it currently IS not on her computer.

Unsecured voice mails
Unsecured voice communications.
Compromised the security of all other systems she dealt with
Hired non-person to set up the system, without security clearance or over site.
Hired non-person to maintain system.

In the real world any of these actions would have triggered an immediate investigation into a possible security breach. All documents and equipment would immediately be take to preserve the evidence. These action would not necessitate high level action but would be done at a repetitively low to mid level.

Unlike Manning, Snowden or Petraeus this is not the real world this is the world of government corruption and cronyism. She is give a pass for the 4 years in office and the two years since then in order to get rid of all the incriminating information she wants. Then when things start to blow up she is given at least several weeks notice to fine tune the deletion of documentations.

This is a charge against the very nature of the government we have become. It is no longer “Of The People By The People and For the People”. It is only a sham of a Democracy and all the World knows it.

These actions of privilege displayed openly by the Government stands as proof of our Democratic demise.
