Ferguson curfew ends after only one night (new video added)

The overnight news out of Ferguson leaves the viewer with some hard work to find a positive spin on it. Yesterday, Governor Jay Nixon announced that there would be a curfew in place from midnight until 5 in the morning until peace was restored to the town. Well, that lasted exactly one night and the curfew is no more. While the order may have kept those inclined toward law and order indoors, others took to the streets resulting in seven arrests and (the last thing we needed to hear at this point) a shooting.

A person is fighting for his life in Ferguson, Missouri, just hours after a curfew was imposed in order to bring calm to a city that’s seen a week of protests and sporadic looting.

Police say one male was shot and seven people were arrested in the city where the police shooting of an unarmed black teenager has sparked days of unrest…

Police have no information on the shooter, Johnson said, but added that there was a person in the street with a handgun and a police car was shot at.

There don’t seem to be any solid estimates of how many people were out in the streets in violation of the curfew, but the interaction with law enforcement apparently didn’t look much different. Of course, given how Capt. Ron Johnson described the official policy toward enforcement, that may not come as much of a surprise.

Earlier, Johnson said law enforcement would not be heavy-handed in enforcing the curfew.

“We won’t enforce it with trucks, we won’t enforce it with tear gas,” he said.

In the end, though, the cops wound up using both smoke canisters and tear gas after the shooting took place. The media already had the Governor on the ropes in terms of trying to balance the First Amendment rights of the protesters against the need to protect persons and property from hoodlums, as well as defending the decision to impose the curfew.

“If there was an easy way to separate those who hurt from those who helped, we would. But it’s hard,” Gov. Jay Nixon said. “And sometimes, especially at night, we can’t.”

“This is not to silence the people of Ferguson or this region or others, but to contain those who are drowning out the voice of the people with their actions,” Nixon said. “We will not allow a handful of looters to endanger the rest of this community.”

His decision stirred instant indignation among many gathered at the community meeting where he announced it. Some screamed out that authorities’ priority should be to provide justice to Brown’s family, not to clamp down on those calling for it.

One interesting side note which may provide a bit more background to the violence and protests comes from a video that CNN’s Victor Blackwell uncovered. It’s taken from somebody’s cell phone who was watching the police activity in the immediate aftermath of the shooting. And as a warning, the language is very coarse and the body of Michael Brown is still laying in the street for the entire thing, so you may want to skip clicking play.

If, as they suggest, this video has been making the rounds locally over social media, it may indeed have been fueling some of the anger. The introductory frames in the video have the bystander with his cell phone (who we’ll call Man 1) speaking with someone else who has arrived on the scene (Man 2) and is asking him questions.

Man 1: They say he had his hands up and everything.

Man 2: They trying to get at him?

Man 1: I don’t know. I wasn’t out here.

This part seems to establish that the owner of the video was not a witness to the shooting. He arrived after the fact, attracted by the sound of gunfire, and is getting his information second hand. But if this video has been making the rounds of the local residents, they probably paid a lot more attention to the next section of film. In the first sentence, it’s pretty clear that the owner of the video is talking about the police when he says “they” but then both of them refer to other persons (also “they”) who have apparently been giving details of what happened before the speaker arrived.

Man 1: They some lousy m***** f*****. They some dirty m***** f*****.

Man 2:They say they stood over him?

Man 1: Yeah. And shot him some more. When he was on the ground. That’s what they said. Shot him some more while he was on the ground.

Man 2:Police killed the dude.

Man 1: Yeah, police killed him. Said he had his hands up and everything. They still shot him. He fell on the ground, they stood over him and shot him some more. They’ve just got him laying in the street, dead as a m***** f*****. They just got him laying here.

Since we’ve yet to hear the officer’s account of what transpired in his own words, and since Michael Brown clearly can’t offer any testimony, we seem to be left with only one eye witness. And that witness winds up being the same person seen in a video helping Brown rob a store a few minutes before the fatal encounter, so you have to assign whatever level of credibility you wish to that testimony. But either way, having this sort of first person “reporting” making the rounds on everyone’s cell phones has no doubt been fueling a lot of the anger and speculation.

On the positive side, the numbers of people out there causing problems at least appears to be decreasing for now, so perhaps some semblance of normalcy will return to the area. The investigation continues.

In fact – they didn’t ENFORCE IT at all. The curfew was completely ignored by the riot animals – Johnson is a clown. The situation needs fewer ‘community organizers’, like Johnson, and more police officers who are serious about restoring law and order.

JFC. The government can impose reasonable time and place restrictions on the exercise of First Amendment rights. A five-hour curfew from midnight to 5 am is reasonable.

Brown’s family had a laundry list of evolving responses to seeing him in the shop tape. Dorian Johnson got his face up in the camera and made him out to be the victim too, but the story Brown’s lawyer says he got isn’t the same one Johnson started out with.
The cops haven’t released their report, but the Brown family lawyer’s getting out in front of it with his own version as fast as he can.
I’ve listened to him twice now. He strikes me about the same way Dorian does with a more expensive suit.

Hard to understand the mentality of people who think they have a right to riot – protest yes, riot no. I realize that the protesters/rioters may be a small group of Ferguson residents but they are the ones who will have to live with the destruction of their community if they sit back. Should we equate the non-rioters to the spposed “good” Muslims? They’re not accountable for the violent ones even if they don’t stand up for themselves?

One thing that struck me about the video — it doesn’t appear to me that there are any signs that Brown was shot in the back. Am I wrong?

Yes, and unless you are a dumb animal, the level of credibility you have to assign to that testimony is absolute zero.

The biggest objection to the curfew is that it cuts into those prime protesting looting hours between midnight and 5 am. Under the circumstances, who needs to make a statement during those hours?

I was watching MSNBC at the end of yesterday’s presser at which Nixon announced the curfew. Some third-string black moderator I didn’t recognize was speaking with two or three black panelists, and all were rending their garments over the curfew. None of the group was older than 35, and yet a five-hour, midnight-to-5-am curfew reminded them of old sundown laws that used to require blacks to be off the street by sundown. Gimme a break.

The police are overwhelmed. That’s why you shoot the looters. Two seconds apiece. Or more like two seconds and one bullet, and the looting all abruptly comes to a halt.

And that is understating the case. Almost always simply the announcement that looters will be shot, when believed, is enough to end it.

“He pulled up ahead of them. And then he got a call-in that there was a strong-arm robbery. And, they gave a description. And, he’s looking at them and they got something in their hands and it looks like it could be what, you know those cigars or whatever. So he goes in reverse back to them. Tries to get out of his car. They slam his door shut violently. I think he said Michael did. And, then he opened the car again. He tried to get out. He stands up.

And then Michael just bum-rushes him and shoves him back into his car. Punches him in the face and them Darren grabs for his gun. Michael grabbed for the gun. At one point he got the gun entirely turned against his hip. And he shoves it away. And the gun goes off.

Well, then Michael takes off and gets to be about 35 feet away. And, Darren’s first protocol is to pursue. So, he stands up and yells, “Freeze!” Michael and his friend turn around. One thing that bothers me is the media constantly repeating that the police force is nearly all white and the residents are mostly black.

Who’s fault is that? It’s not enough to say the force is racist, that it doesn’t let blacks in, that it has a bad reputation, etc. In communities of all types, when the membership changes radically, they wrest control away from the old guard, by hook or by crook. That the black community of Ferguson hasn’t done this over so many years of demographic change is telling.

The “Man 1″ who said “I don’t know”, it’s probably the last time any of the protesters said “I don’t know”. Oh, they KNOW very well. He was on his knees with his hands up, pleading “please don’t shoot me”, and they shot him dead, like a dog, and then walked up to him and fired more shots into him as he lay on the ground. Jazz, the link has nothing on the curfew being cancelled. Unless CNN has edited that information out of the story, (and I find no other story indicating the curfew has been cancelled) I suppose I’ll have to chalk this up to your pathetic exaggeration for rhetorical effect which itself is inaccurate since it would then need to be described as lasting “not even one night”, not “one night”.

Yeah, because this cop just absolutely wanted to kill him a black guy just so he could go through all this crap of having his life threatened and the lives of his family and to risk his career and possible jail time. Yep, that’s the way it had to go down, because that makes so much more sense than possibly that Brown was high on something and didn’t go down from the first shots and kept charging the cop. Yep, you got it all figured out.

I give pretty much Zero credibility to those “eye witness” accounts. 15 years ago I was an appraiser doing some drive by comparables in a black neighborhood in Queens, NY. It was snowing and ice on the road, I stopped at a stop sign, then started to proceed across the interection then stopped again when I car came flying by out of nowhere and crashed into a telephone pole. The street was deserted, I pulled across the street and got out and walked up to the car, the driver sat with his eyes closed sitting straight up in the seat, no apparent injuries and no seat belt on. I knocked on his window and he did not respond.
I went back to my car (no cell phone) and waited. The cops arrived and all of a sudden the blacks came pouring out of the houses and started pointing at me. The cops questioned me asking if I had hit the guy, my car had not come within 10 feet of his. They gave me back my license, shook their heads and told me to get the heck out of there as quickly as possible. In other words, the “eye witnesses” had decided that the middle aged white woman was at fault.

One really has to be careful believing what people say. You have to put everything together in an investigation and see what is supported and what makes sense. There are well meaning people and liars willing to give their account. Often the well meaning make guesses about what they saw rather than recounting what actually happened.

You’re giggling at what you suppose is hidden beliefs. Let’s put them out there so you can have a really big laugh:

1. people who riot and loot are like animals
2. people who riot and loot probably don’t have jobs
3. there were riots because Michael Brown was black; wouldn’t have happened if he was white

There. Now go laugh your head off. And don’t tell me it wouldn’t have happened had he been white. Plenty of white people are shot by police, and I’ve not heard of a riot yet. A few months ago, a 19 year old white woman was shot just a few miles from where I live, as she slowly drove away from an outside party by the river, where there might have been illegal drinking. There’s even a videotape. She didn’t do anything wrong, except to ignore the cop’s signal to stop. He jumped on the hood and shot her through the windshield, dead. No riots.

And what about whites who, like Michael Brown did, assaulted a cop, where the cop then shoots him dead? There are those too. Still, no riots.

At first it begins with “they said” which could refer to one, or more people telling what they actually witnessed, or even what was simply overheard from others. Then the “they” is dropped completely and the new version removes all traces of doubt and it is spoken as if it were a fact.
These are folks not only wiling to accept that as a reason for “righteous” looting and lawlessness but are actively seeking it as an excuse for their behavior.

When I was in a HS journalism class back in the 70′s, an assistant principal and a coach came into the classroom started a loud argument/altercation, shot a starter pistol and ran out.

We were asked to write down what happened, right in front of us, in as much detail as possible. No one got it completely correct. There were many discrepancies in what was said, what they were wearing, whether they actually hit each other, who shot the pistol… It was an eye-opener. (And, I can’t imagine a HS letting valuable lesson be performed today. The school would be on lock down, the SWAT team called and the teacher, asst. principal and coach would most likely be fired (or, through the union reassigned to a “rubber room.”)

I actually did a psychological experiment when I was in college. Showed a video of a robbery to a bunch of subjects (separately) and then gave them a questionnaire about what they’d seen. I got widely different results. One thing that struck me? The more educated individuals got more right. Go figure.
