Eric Holder orders additional autopsy on Michael Brown. Wait… what?

I was traveling most of the afternoon, so I’ll probably rely on some of the usual eagle eyed commenters with legal backgrounds, as well as our usual sources, for some more details on this one. As the situation in Ferguson continues to roil, and the curfew is extended for another night (contrary to previous press announcements) Attorney General Eric Holder is getting involved.

Attorney General Eric Holder called for another autopsy to be performed on slain black teenager Michael Brown, whose shooting by a white cop in a St. Louis suburb has sparked violent protests that left a man critically wounded early Sunday.

“Due to the extraordinary circumstances involved in this case and at the request of the Brown family, Attorney General Holder has instructed Justice Department officials to arrange for an additional autopsy to be performed by a federal medical examiner,” Justice Department spokesman Brian Fallon said in a statement.

“This independent examination will take place as soon as possible,” he continued, adding that officials will still take into account the state-performed autopsy during their probe.

The Brown family legal team also hired a reputable forensic pathologist to conduct its own autopsy of the 18-year-old’s body.

Their own spokesperson is using the phrase “extraordinary circumstances” here, so that seems to be an acknowledgement that the normal protocols are in flux. I’m not suggesting that this is illegal – unless somebody can cite a specific instance to make that case – but what is there about the death of Michael Brown that makes this a federal case? If you sweep aside the wall to wall media coverage and celebrities flocking to Ferguson, this is a case of one person who was shot during a confrontation with a local police officer, allegedly on the heels of a low dollar value robbery at a convenience store. Nobody crossed state lines that I’m aware of. And when you look at it in that perspective, there are many such cases around the country every year. (Many more than we would like to see, it should go without saying.)

We try not to leap to conclusions, but it seems there is a rather obvious case to be made that the Obama Administration (unless Holder took this upon himself without approval, which seems unlikely in the extreme) has decided to latch on to this incident and it has political fingerprints all over it. How else would you explain it? Yes, the Brown family attorney supposedly made the request, but I’d be willing to wager that most every family in the country – of any race, religion or otherwise – who lost a family member in violent, questionable circumstances would love to have big guns like this brought to bear. But they don’t get it. And that, again, is assuming that it’s even appropriate for the feds to be injecting themselves into an ongoing investigation to begin with. There haven’t even been any charges files, to say nothing of a trial being held which some might dispute after the outcome. I don’t care for the looks of this at all.

but what is there about the death of Michael Brown that makes this a federal case? If you sweep aside the wall to wall media coverage and celebrities flocking to Ferguson, this is a case of one person who was shot during a confrontation with a local police officer, allegedly on the heels of a low dollar value robbery at a convenience store. He and King Putz claim it’s a civil right issue. Latest I read on this Brown ran some 25 feet after beating on the officer who ordered him to freeze. Brown charged the officer according to two separate accounts.

It has been speculated Brown may have been affected by drugs of some sort. No doubt Mr. Fast & Furious wants to muck up the evidence.

It’s not uncommon for the family to ask and pay for another autopsy, particularly when they plan on suing someone over it. The issue will not be the cause of death because that’s obvious. The issue will be whether the deceased was under the influence of alcohol or drugs at the time of death. Holder can get involved because potentially, there could be a civil rights violation.

Sorry. After the first investigation by the local DA and local police, they sent the evidence to the FBI for a impartial review. FBI came back: looks like self-defense to us.

Then because of the ginning up of “public opinion,” Corey was appointed to take a third look at the evidence.

True, Holder’s “investigation” has not been concluded. However, he would have to claim the first FBI review missed something. And he would have to find some evidence that a “white Hispanic” who tutored black kids was a racist.

Whatever investigation Ferguson Police, St. Louis County, or State of Missouri does will not be believed.

Normal procedure is for the feds to become involved after a not guilty verdict like in Mississippi in ’64 or where the local prosecutor steps aside like in the Abner Louima case. It is very unusual for the DoJ to take over a case at this stage. As for Lucky Ned’s desire for a special prosecutor, that implies DoJ would not be fair and needs to go outside for counsel. The governor or his AG could well appoint a special prosecutor to take pressure off the St. Louis DA.

Missouri Rep.: I Have ‘No Confidence’ In Ferguson Police Investigation (VIDEO)

Rep. Lacy Clay (D-MO), who represents Ferguson, Mo., on Saturday said that he doesn’t trust the Ferguson police to conduct a fair investigation into the death of Michael Brown, the black teen who was shot by a police officer.

“I have absolutely no confidence in the Ferguson police, the county prosecutor,” Clay told CREDO’s Ferguson Justice Live. “We know we won’t get a fair shake there.”

The congressman slammed the local police for releasing a video that allegedly shows Brown robbing a convenience store.

“That’s why they did what they did today, was to negatively influence a jury pool in St. Louis County,” Clay said. “Just to assassinate Michael Brown’s character is wrong. He was already assassinated, so now you’re going to assassinate his character? What kind of human being are you? That’s the kind of question I have to ask.”

Missouri Gov. Jay Nixon (D) also criticized the Ferguson police for releasing the video, which he called “an attempt to attack his character.”

The same thing it always is: the racial grievance industry is pushing the line that the police officer infringed on Brown’s civil rights by murdering him as part of the systematic oppression of African-Americans, so the second autopsy is to prevent an imagined conspiracy to rob Brown of victim status.
It is also to ride the toxic wave of “you can’t trust the cops” that is spewing out of this.

Nothing about this case supports any form of federal law enforcement jurisdiction. But if the family wants a DOJ autopsy there is no law against it.

I wonder how they are budgeting the expense involved though. And the expense of all those FBI agents (and federal agents of every other stripe, no doubt) that have been deployed to Ferguson. How is the Obama administration justifying these expenditures in the absence of federal jurisdiction?
