Wait a sec: Ferguson police chief says initial contact with Brown wasn’t connected to robbery; Update: Cop figured it out during stop?

Why’d they release the surveillance footage then? The point, I thought, was to show that Darren Wilson wasn’t hassling Michael Brown and Dorian Johnson because they were black but because he knew they were suspects in a felony. But he didn’t know.

Ferguson Police Chief Thomas Jackson told reporters Friday that “the initial contact between” Michael Brown and the police officer who fatally shot him was not related to the alleged convenience store robbery committed nearby a short time earlier.

The officer approached Brown not because of the robbery, but “because they were walking down the middle of the street blocking traffic,” Jackson said.

In case there’s any ambiguity:

Johnson acknowledged in interviews that they were walking in the middle of the street but says no drivers were honking or yelling at them about blocking traffic. And he claims that when Wilson drove up, his first words were, “Get the f*** on the sidewalk.” Assuming that’s true, evidently it wasn’t the sound of a cop nervous that he’d just stumbled across two suspects in a convenience store robbery, it was the sound of a cop who was pissed off that a couple of jaywalkers weren’t moving fast enough. If Wilson ends up being tried, much will be made of just how pissed off he was when he pulled his gun. Also, Sean Davis smartly points out that this may have implications for Wilson’s defense under the Missouri statute governing police use of deadly force. A cop’s allowed to shoot a suspect who’s attempting to escape from custody if he reasonably believes (a) that deadly force is needed to make the arrest and (b) that the suspect committed a felony. He can’t use the convenience store robbery for the second part of that now. And purely as a PR matter, it’s obviously harder for Wilson and the PD to defend a lethal encounter that began with a stop for jaywalking than one that began with a stop for robbery. The public may not want to admit it but they’re willing to let cops play rougher with suspects accused of more dangerous crimes. Blocking traffic is annoying but it shouldn’t lead to a man lying dead on the asphalt.

So why’d they release the footage? Seems like they did it not to suggest something about Wilson’s state of mind in arresting Brown but something about Brown’s state of mind in being arrested by Wilson. It was always hard to believe that someone detained for blocking traffic would turn desperate enough to grab at a cop’s gun. It’s not as hard to believe that someone who thought he was being hauled in on a felony charge might have panicked. One thing I’m still unclear on, though, is when Wilson finally learned that Brown was a suspect in the robbery. He didn’t know it when he first stopped him; did he find out during the encounter? Watch this clip of the Ferguson police chief from earlier this morning describing the timeline. A description of the suspects in the robbery was allegedly sent out over police radio before Wilson encountered Brown. Maybe Wilson wasn’t paying attention to his radio or had it off or whatever. What if he turned it on while Brown was in the squad car, though, and suddenly realized who he had? What if Brown heard the radio broadcast too and panicked? I’m spitballing but who knew what and when will matter when a jury has to decide whose version of the shooting it believes.

Update: Sorry, bad facts in the last paragraph about Brown being inside the squad car. Here’s how the NYT describes what police say happened:

The police on Sunday said they were still trying to sort out the exact details, but they released what they said was the fullest account of the shooting that they could provide. Just after noon on Saturday, the police said, an officer in a patrol car approached Mr. Brown and another man. As the officer began to leave his vehicle, one of the men pushed the officer back into the car and “physically assaulted” him, according to the police department’s account.

A struggle occurred “over the officer’s weapon,” and at least one shot was fired inside the car, Chief Belmar said. The two left the car, and the officer shot Mr. Brown about 35 feet away from the vehicle, the police reported. Several shots were fired from the officer’s weapon.

Assuming Brown was the one who allegedly pushed Wilson, he may have been inside the car but he wasn’t sitting there listening to the police radio. Then again, if Wilson had the window down, the police radio may have been audible to both men while they were talking. If a description of Brown as the robbery suspect came across at the wrong time, it might have set both of them off.

Update: Verrrry strange that the Ferguson police chief wasn’t clearer during his presser about what Wilson did and didn’t know, but here you go. He told the St. Louis Post-Dispatch later that Darren Wilson appeared to have pieced together Brown’s involvement in the convenience store robbery while he was talking to him:

Jackson said the officer was aware cigars had been taken in the robbery of a store nearby, but did not know when he encountered Brown and Dorian Johnson that they might be suspects. He stopped them because they were walking in the street, Jackson said.

But Jackson told the Post-Dispatch that the officer, Darren Wilson, saw cigars in Brown’s hand and realized he might be the robber.

Did Wilson tell Brown that he suspected him of the robbery because of the cigars?

in a free society the burden of proof for violent state action against a citizen lies on the state, not on the citizen.

So yes, innocent until proven guilty applies to the police officer. However, said police officer should be in police custody and subject to the same if not stricter levels of investigation that would take place if Joe Public had killed someone during an altercation.

Lets take the race bit out of it since its really irrelevant. (of course someone will point out all the reasons it isn’t irrelevant and likely mention black thugs, black animals, or black on black crime)

We give police the benefit of the doubt in using weapons both because of what we entrust them to do (policing the worst of the worst) and because of the possible consequences of that work. Consequently, when something goes wrong they should be held to a higher standard than the rest of us.

Think about it. Rightly or wrongly George Zimmmerman went to jail for shooting Trayvon Martin. He was arrested, processed, charged, prosecuted, etc. What didn’t happen was setting him free to roam around on his own while his coworkers checked the files to make sure he did everything correctly.

Police’s job is difficult, no question. It should be because it is the public legitimated use of deadly force in order to maintain law and order. Even so the job of the police is NOT to shoot people. Shooting someone represents a failure to do the job by other means. It may at times be necessary, but it should only be a last resort and far too often it isn’t seen or practiced that way. So we have people talking about ‘collateral damage’ as if we’re at war…. but we’re not at war. Crime is not war. Shoplifting is not war. Assault is not war. Assaulting a police officer isn’t war.

So, I haven’t paid much attention to this story up until now. All I knew was a LEO shot a young black male in St. Louis and looting and property destruction ensued, race baiters convened to engage in race baiting, and some were complaining because the cops were dressed in riot gear. Also, protests were being held in cities across the country, for some reason. Agitators gotta agitate, I guess. Oh, yeah, and Preezy made some sort of vague non-committal statement. And some dipshit congressman called for martial law.

And all this time no one none of those people had any real facts about what led to the shooting. Is that about right?

The officer who shot Ferguson teen Michael Brown stopped Brown and another teen because they were walking in the street, not because of a robbery a few minutes earlier, Ferguson Police Chief Tom Jackson said Friday afternoon.

Jackson said the officer was aware cigars had been taken in the robbery of a store nearby, but did not know when he encountered Brown and Dorian Johnson that they might be suspects. He stopped them because they were walking in the street, Jackson said.

But Jackson told the Post-Dispatch that the officer, Darren Wilson, saw cigars in Brown’s hand and realized he might be the robber.

Jackson also addressed concerns about his release of information about the robbery at the same time he released the name of the officer at a press conference Friday morning.

Jackson said he released the security video from the liquor store because news organizations had been requesting it under the Freedom of Information Act.

Asked by reporters why he released the tape, he said, “Because I had to. Too many people put in (freedom of information) requests for it.”

but, in this case, the media, including blogs, have been essentially pouring gasoline on the fire.

One issue is the biases become quite clear when there is incomplete information, Police are bad, Police are racist, Scary vehicles cause riots….whatever one’s prejudice becomes the news.

It is very tiresome…and dangerous. US Today has a major piece on how black people are more or less shot on sight across the county.

STL Post-dispatch tweeted out last night that they REALLY need to talk to the guy who threw back the tear gas canister the other night. The P-D is a pretty left wing paper and considers that to be an iconic pix of the people against the Man…truth to Power, etc.

There’s only one reason why a felon wants your gun, and that’s because he doesn’t have one of his own and he wants yours to kill you. If you manage to retain it and then bring it to bear, shoot until he stops trying. This is a justified use of deadly force in every law enforcement agency in America. Furthermore, if, after trying once, failing, and being confronted by an armed officer who is sighted in and ordering him to the ground, he charges that officer, the officer can certainly reasonably conclude that he’s decided to have another try. It doesn’t matter that he’s unarmed, shoot until he stops trying.

And then eventually after riots, protests, a lot of pressure release information implicating the dead man in a robbery. Only to later say “Oops. The robbery is unrelated to his death. Totes my bad yo.”

At best it makes them look incompetent. If they intended to say something about Brown’s state of mind, they really need to be explicit. Come out and say exactly that. Say “Brown had just robbed a store and thought he was about to be arrested.” Or say nothing at all. Beating around the bush, and hinting about what might or might not have happened just makes them look terrible.

Crime, depending on the crime, of course, check. Shoplifting, check. Assault, if not life threatening, check. Assaulting a police officer, no check. Police officer’s carry a weapon and if disabled, the wrongdoer can gain possession of it for purposes of harming the officer or others after fleeing.

This is not the Jim Crow South. Something went horribly wrong. But I’m seeing enough in the cop’s favor to argue that the looting showed the looters to be a disgrace to this country and to argue that the race hustlers and the media ought to back off, vigilantly shine lights on the investigation, and turn the spin machine off.

And make no mistake, if this had been a white decedent who supposedly robbed a store, assaulted a cop, and ultimately rushed the cop, I’d be disappointed that the cop wasted so much lead taking him out.

It would be a good idea for some of the bleeding heart left to have to go one on one or say platoon on platoon with say some NVA all strung up on meth, or down in a white trash meth cooking area and deal with how strong and hard to fight or bring down some are in a fight to the death.

At best it makes them look incompetent. If they intended to say something about Brown’s state of mind, they really need to be explicit. Come out and say exactly that. Say “Brown had just robbed a store and thought he was about to be arrested.” Or say nothing at all. Beating around the bush, and hinting about what might or might not have happened just makes them look terrible.

You DO understand how investigations work right? That they don’t just spontaniously occur…and that for the most part, the investigation is going to have a LOT of back and forth throughout…

Witnesses have to be interviewed (multiple times at that), video looked at, a PRECISE timeline built.

The biggest problem with media cases like this is that EVERYONE expect results in 30 minutes or less: as I stated repeatedly, it DOESN’T work that way, and if it ever DID,I’d be more concern with the outcome.

My point though was that average Joe Citizen having shot someone would most likely be sitting in a jail cell somewhere while the initial investigation took place. Police lock Joe Citizen up on allegations that they shot someone, yet when Joe Policeman does its ‘administrative leave with pay’. Who pays Joe Citizen for the days he’s arrested and locked for alleging to have shot someone?

I know what let us just withdraw all police from the “Urban Black Community”. That is what they want in those communities, that is what they shall get. Obviously to all store and property owners in those neighborhoods it will suck, but hey all investments and businesses are a gamble. Take the loss and move on. I say police the communities that want policing, like the police, and don’t police those that don’t want the police. That is about as American as you get…locals get to decide.

That way we don’t have to worry about cops killing young males in those communities, and the rest of us don’t have to worry about policing those communities anymore. That is what the Chicago police did, they just let those communities, that hate the police, do what they want, and when they find someone, from those cop hating communities, shot dead, or strangled, or beaten to death they write it off as death by natural causes, or suicide, etc. In the communities that like the police they classify it as a murder and do an investigation. I don’t agree with that, but that sounds like what you want Aqua…no police for you…ok…

Interesting call. CNN just reported that the officer did not initially stop Brown on suspicion of robbery per the police chief. However, the officer picked up the robbery call after the initial interaction, which would make sense.

In my experience, and I have plenty, criminal thugs often aren’t the sharpest knives in the drawer. Based on my experience and the emerging facts, I’ll suggest a likely scenario:

Thugs commit a strong arm robbery. (Yes, both of them, even if they don’t charge thug number 2 due to lack of evidence. He distracted the owner while Brown grabbed the cigars.)

Then, thugs draw attention to themselves by parading down the middle of the street. Must have felt like really big men after assaulting and intimidating an old man half Brown’s size. During the ensuing encounter, the officer realizes he has the robbery suspects, whereupon Brown assaults him, tries to take his weapon, and failing that flees to avoid arrest.

Some history that the African Americans of the time were the “buffalo troopers.

The mother didn’t raise him Michael Brown. He was living with his Grandmother. His mother was sued for child support. His mother was on 5 years probation for a host of drug and theft charges. The mother pled guilty to domestic violence as well in 2011. The mother has also been sued by about every creditor in town. The mother has five pages of Court Cases on Mo Casenet. The grandmother sued Mike Browns dad for child support. Neither of Michael Browns parents gave a crap about him……until now. It’s really quite tragic.

I’m sorry to break it to you, but, not every investigation goes smoothly – not every detail is released immediately. Plus, in this case, hours after the shooting became news, the Ferguson police department, and city offices were inundated with death threats, and soon, the city was under siege from rioters and looters – so, it is no surprise that the police took their time in releasing information.

It appears that it is not as simple as “cops shoot unarmed man in back” – seriously, if you examine the information that we have gotten so far, there is much, much more to the story. And, as far as “the robbery is unrelated to his death” statement – what really happened is becoming clear – we are talking about events that transpired minutes apart – there is still confusion about exactly when Officer Wilson realized that Brown was the robbery suspect – but, these facts will be clarified in time.

There are always going to be people such as yourself who blame the police, no matter what, but really, very few people who are PAYING ATTENTION think that the police look bad in this.

Cops never figured it out, they are still looking for a 6’5″ 290 pound young black man who lives in the vicinity of Ferguson, Missouri.
Of course, being local cops, none of them had ever seen Big Mike before. Cops are widely known for not paying attention to what is going on in the communities around them. This young giant black kid showed up from nowhere one day and robbed the local Quick Trip which was subsequently burnt down. It’s a mystery to the folks in Ferguson, Missouri.

EW ORLEANS — Two people were killed and five others, including three children, were shot in the Lower Ninth Ward Sunday night, the New Orleans Police Department said.

Two children, ages 2 and 4, and another victim were in critical condition, and two other people — a girl, 13, and a woman, 37, — were stable, police spokesman Frank Robertson said. An 18-year-old woman and a man are dead. The slain man appeared to be in his late 20s, Robertson said in an email.

Robertson said all of the shooting victims were in front of a house when a dark car occupied by men drove up, opened fire and sped off. Witnesses said several people were on the porch.

Robertson said that witnesses observed a dark-colored vehicle, possibly a Honda Accord, with a Louisiana commercial license plate fleeing the scene.

The incident occurred around 8 p.m. Central Time in the 5400 block of Burgundy Street.
