Wait a sec: Ferguson police chief says initial contact with Brown wasn’t connected to robbery; Update: Cop figured it out during stop?

Why’d they release the surveillance footage then? The point, I thought, was to show that Darren Wilson wasn’t hassling Michael Brown and Dorian Johnson because they were black but because he knew they were suspects in a felony. But he didn’t know.

Ferguson Police Chief Thomas Jackson told reporters Friday that “the initial contact between” Michael Brown and the police officer who fatally shot him was not related to the alleged convenience store robbery committed nearby a short time earlier.

The officer approached Brown not because of the robbery, but “because they were walking down the middle of the street blocking traffic,” Jackson said.

In case there’s any ambiguity:

Johnson acknowledged in interviews that they were walking in the middle of the street but says no drivers were honking or yelling at them about blocking traffic. And he claims that when Wilson drove up, his first words were, “Get the f*** on the sidewalk.” Assuming that’s true, evidently it wasn’t the sound of a cop nervous that he’d just stumbled across two suspects in a convenience store robbery, it was the sound of a cop who was pissed off that a couple of jaywalkers weren’t moving fast enough. If Wilson ends up being tried, much will be made of just how pissed off he was when he pulled his gun. Also, Sean Davis smartly points out that this may have implications for Wilson’s defense under the Missouri statute governing police use of deadly force. A cop’s allowed to shoot a suspect who’s attempting to escape from custody if he reasonably believes (a) that deadly force is needed to make the arrest and (b) that the suspect committed a felony. He can’t use the convenience store robbery for the second part of that now. And purely as a PR matter, it’s obviously harder for Wilson and the PD to defend a lethal encounter that began with a stop for jaywalking than one that began with a stop for robbery. The public may not want to admit it but they’re willing to let cops play rougher with suspects accused of more dangerous crimes. Blocking traffic is annoying but it shouldn’t lead to a man lying dead on the asphalt.

So why’d they release the footage? Seems like they did it not to suggest something about Wilson’s state of mind in arresting Brown but something about Brown’s state of mind in being arrested by Wilson. It was always hard to believe that someone detained for blocking traffic would turn desperate enough to grab at a cop’s gun. It’s not as hard to believe that someone who thought he was being hauled in on a felony charge might have panicked. One thing I’m still unclear on, though, is when Wilson finally learned that Brown was a suspect in the robbery. He didn’t know it when he first stopped him; did he find out during the encounter? Watch this clip of the Ferguson police chief from earlier this morning describing the timeline. A description of the suspects in the robbery was allegedly sent out over police radio before Wilson encountered Brown. Maybe Wilson wasn’t paying attention to his radio or had it off or whatever. What if he turned it on while Brown was in the squad car, though, and suddenly realized who he had? What if Brown heard the radio broadcast too and panicked? I’m spitballing but who knew what and when will matter when a jury has to decide whose version of the shooting it believes.

Update: Sorry, bad facts in the last paragraph about Brown being inside the squad car. Here’s how the NYT describes what police say happened:

The police on Sunday said they were still trying to sort out the exact details, but they released what they said was the fullest account of the shooting that they could provide. Just after noon on Saturday, the police said, an officer in a patrol car approached Mr. Brown and another man. As the officer began to leave his vehicle, one of the men pushed the officer back into the car and “physically assaulted” him, according to the police department’s account.

A struggle occurred “over the officer’s weapon,” and at least one shot was fired inside the car, Chief Belmar said. The two left the car, and the officer shot Mr. Brown about 35 feet away from the vehicle, the police reported. Several shots were fired from the officer’s weapon.

Assuming Brown was the one who allegedly pushed Wilson, he may have been inside the car but he wasn’t sitting there listening to the police radio. Then again, if Wilson had the window down, the police radio may have been audible to both men while they were talking. If a description of Brown as the robbery suspect came across at the wrong time, it might have set both of them off.

Update: Verrrry strange that the Ferguson police chief wasn’t clearer during his presser about what Wilson did and didn’t know, but here you go. He told the St. Louis Post-Dispatch later that Darren Wilson appeared to have pieced together Brown’s involvement in the convenience store robbery while he was talking to him:

Jackson said the officer was aware cigars had been taken in the robbery of a store nearby, but did not know when he encountered Brown and Dorian Johnson that they might be suspects. He stopped them because they were walking in the street, Jackson said.

But Jackson told the Post-Dispatch that the officer, Darren Wilson, saw cigars in Brown’s hand and realized he might be the robber.

Did Wilson tell Brown that he suspected him of the robbery because of the cigars?

Whatever Officer Wilson did can play out wherever it needs to- in court, or a suspension hearing, or nothing at all.

It still won’t make me give a half a sh** about some ignorant, malevolent piece of garbage too stupid to low-profile it after committing robbery.

Yeah, this was a nightmare scenario for me. I was in law enforcement for 35 years and this was one of the ones that kept me awake. You’re out there, going through the routine, making a “normal” encounter with a citizen, who, unbeknownst to you, has just committed a major felony. HE knows he’s just committed the major felony, but you don’t. One second, you’re exchanging words and the next you’re fighting for your life because HE thinks you’re there about the felony he just did. From your perspective, it’s completely irrational, out of the blue behavior, and all you know is this guy went absolutely Rambo on you for no obvious reason. You cannot appreciate until you have been in that position, the utter shock and disbelief, the “this guy’s trying to kill me! Why?” shit that’s going through your head, all while you’re fighting it out.
Add in the fact that the guy probably outweighed the officer by a hundred pounds and had six inches on him and he had an accomplice standing by, I can see why this went to guns. Don’t know what the investigation will show, but I see clearly how this thing started.

I’ve been trying to come up with a logical sequence of events as to how the dude got shot……

1. Officer makes initial contact, doesn’t realize who Brown is
2. Starts to drive away, realizes or hears on radio Brown matches description of robbery suspect.
3. Officer goes back, tries to question Brown
4. Scuffle ensues, Brown punches officer and tries to take his sidearm
5.Officer shoots Brown inside car.
6. Brown, now wounded, tries to retreat.

So far, makes some sort of sense…… Here’s where it gets messy……

7. Brown, now in street and shot, is either trying to get away from officer, or debating with himself whether to give up.
8. Officer, in a rage from being assaulted and almost having his weapon taken away, shoots Brown several more times,
Or 8a. Officer, in a rage from being assaulted and almost having his weapon taken away, and thing Brown is approaching to attack again, shoots Brown several times.

If it was 8, and it’s true Brown was shot in the back, the officer executed him.
If it was 8a, the officer may have had cause.

The back shot, if true, is the troubling part I can’t make sense of.

Officer Darren Wilson was most likely initially trying to protect these 2 black men by getting them to move out of the street so they wouldn’t be hit by a car.

The challenge is going to be that while the Police most likely have the exact time of the radio announcement of the robbery, it may not be possible to tell the exact time of the gun shot(s).

Per GatewayPundit, a friend of Wilson’s called in to The Dana Loesch radio program today. For what it is worth. I’d rather hear more from the eyewitness who supposedly confirmed and contradicted some of the story line about the encounter or see the actual incident report than listen to hearsay.

I think we’re way overthinking the “Brown hearing police radio thing.” He’d just robbed a store – isn’t it a given that he’d be skittish of police?

So, if Wilson didn’t know that Brown was a suspect (even though he had been dispatched to the area to look for the suspects), he was being very proactive, and is obviously a fabulous cop. I would say that Darren Wilson really deserves a medal for his actions – A true hero.

Had a situation where 3 of my officers contacted a subject on a misdemeanor warrant–wanted party half size of Brown—struggle ensued and he went for Sgt’s 9mm–even with 3 officers on him, he wouldn’t give up. With his hands on Sgt’s pistol grip still holstered, another officer ended the struggle–permanently. Jury had no issue with it either, even though 3 on 1.

“He pulled up ahead of them. And then he got a call-in that there was a strong-arm robbery. And, they gave a description. And, he’s looking at them and they got something in their hands and it looks like it could be what, you know those cigars or whatever. So he goes in reverse back to them. Tries to get out of his car. They slam his door shut violently. I think he said Michael did. And, then he opened the car again. He tried to get out. He stands up.

And then Michael just bum-rushes him and shoves him back into his car. Punches him in the face and them Darren grabs for his gun. Michael grabbed for the gun. At one point he got the gun entirely turned against his hip. And he shoves it away. And the gun goes off.

Well, then Michael takes off and gets to be about 35 feet away. And, Darren’s first protocol is to pursue. So, he stands up and yells, “Freeze!” Michael and his friend turn around. And Michael taunts him… And then all the sudden he just started bumrushing him. He just started coming at him full speed. And, so he just started shooting. And, he just kept coming. And, so he really thinks he was on something.”

As noted before, this revelation seems to shed negative light on the officer with the implication that he had no reason to interact with the deceased and his friend. Actually I think it points out what the state of mind was of brown. He may have just committed a crime and is accosted by a police officer. he may not know the officer does not know of the crime. Brown may have panicked and might have thought the officer was going to arrest him or question him. Things may have spiraled out of control from there, with the officer not knowing what Brown knew. I would say that one must take with a huge grain of salt what Brown’s companion says since he was in on the previous crime.

Add to this the fact that Brown was 6 foot 4 inches and about 300 lbs, and that would make anyone think their life is in danger, particularly in the wake of the assault in the squad car. That would justify the use of deadly force…but a grand jury or court case may need to make the final decision.

If these are the facts, and this seems more likely than the claims of Brown’s accomplice, then where is the apology from the community, the eye witness who lied, the race baiters, the racial thugs who arrived from Chicago, NYC, and Philadelphia? Particularly to the businesses looted and destroyed?

So, I haven’t paid much attention to this story up until now. All I knew was a LEO shot a young black male in St. Louis and looting and property destruction ensued, race baiters convened to engage in race baiting, and some were complaining because the cops were dressed in riot gear. Also, protests were being held in cities across the country, for some reason. Agitators gotta agitate, I guess. Oh, yeah, and Preezy made some sort of vague non-committal statement. And some dipshit congressman called for martial law.

And all this time no one had any real facts about what led to the shooting. Is that about right?

“He pulled up ahead of them. And then he got a call-in that there was a strong-arm robbery. And, they gave a description. And, he’s looking at them and they got something in their hands and it looks like it could be what, you know those cigars or whatever. So he goes in reverse back to them. Tries to get out of his car. They slam his door shut violently. I think he said Michael did. And, then he opened the car again. He tried to get out. He stands up.

And then Michael just bum-rushes him and shoves him back into his car. Punches him in the face and them Darren grabs for his gun. Michael grabbed for the gun. At one point he got the gun entirely turned against his hip. And he shoves it away. And the gun goes off.

Well, then Michael takes off and gets to be about 35 feet away. And, Darren’s first protocol is to pursue. So, he stands up and yells, “Freeze!” Michael and his friend turn around. And Michael taunts him… And then all the sudden he just started bumrushing him. He just started coming at him full speed. And, so he just started shooting. And, he just kept coming. And, so he really thinks he was on something.”

But I’m sure the brave police officer probably feared for his saftey after the first 5 shots hit Brown, so he had to make sure he was totally dead before doing anything else.

I work from home as a copy typist for a prison pen pal service (I know, but I need the money) and I can’t believe how cocky and confident these guys are. If the toxicology report takes up to four weeks to complete, it means it takes time to quantify all the drugs that he was on. The initial toxicology screen takes one day. If it came up negative, it would be reported immediately. What takes time is they have to do a separate extraction for each drug category that came up in the initial screen.

This is why the identity of the cop revealed so that there can be a month-long media lynching before the results arrive. Then, when the results show that a 6’4″, 290 lb guy was on something, the cops can be accused of a smear campaign.

I don’t steal stuff, and I don’t commit crimes. I’ve gone wobbly the three times I’ve been stopped for speeding in 35 years. Why does anyone challenge a cop?
